How can they claim compo? Surely that would be like us trying to claim our bit of say Christiano Ronaldos transfer fee to Madrid. Different company, different team.
This could be an awesome signing. It's great to see us signing players who are genuinely exciting when you hear their name, rather than someone you've never heard of and have to convince yourself that they are good.
Because they bought the footballing assets of the club which includes registrations and player contracts in just the same way that when Sainsburys bought Jacksons (just to give a local example) the staff automatically transferred. If Aluko is eventually ruled in breach of contract we'll only be liable for the money Green paid for his contract as compensation in breach of contract in Scots law is restricted to returning the wronged party (theoretically Green) to the position they would have been in had they not entered into the contract* (or in this case bought into). Fortunately for us Green bought all the assets for £4.5M, and the players contracts were specified as either £1.8M or £2.7M. I can't remember which way round the split was, but even if it's £2.5M, given the other players they had we'll be looking at paying them less than Proschwitz's monthly salary. *On the same basis, if say McLean was to walk out on us now in a breach of contract the compo awarded to us could be his entire transfer fee and every penny of the wages we've paid him, although there would more than likely be a reduction in that amount due to the service we have had from him. Obviously FIFA could have internal rules that alter the compo upwards, but given they've issued temporary registrations to the other Rangers rebels it seems they're going to just follow the courts' ruling on it. Of course to be in breach of contract there has to have been a valid contract. His initial contract was til the end of the season, but Rangers had the option of extending it for 2 years, so his out of contract status depends on whether notification of an intention to activate the clause was provided to Aluko in the correct timeframe. My guess would be that as the administrators weren't allowed to extend contracts they didn't, and that Green bought the assets too late to be able to take up the option. In which case the maximum compensation Rangers would be due (as he's under 24) would be based on how many years youth training he received from them, which is clearly none as he only joined them in November, and Aberdeen were only claiming it for 3 of the 4 years he was with them.
So the company went out of business but someone was able to buy all the players contracts without them agreeing to it? I can't believe that, what would have happened if an afghan company decided to buy the playing assets and start a new team in Afghanistan? Would they have been legally obliged to uproot and go to a place where they'd probably have been blown up within a week?
No, that would be a material change to their contract and they'd be able to claim breach of contract themselves against the club for trying to make them move, in the same way that if your employers tried to move you to Afghanistan you'd claim consructive dismissal as the changes they made made it impossible for you to continue your family and work life as it was.
I thought Green was trying to change the contracts? Certainly reduce payments and terms - as they are fixed he was in breach.
Way back whilst they were in admin the administrators negotiated with the players a wage reduction in order to ensure the club saw out the season. I think each player negotiated their own deal because they all seem to have different conditions they want meeting. I think some (mainly the foreigners) did it as they could leave for knock down fees in the summer if they agreed to drop wages, but if nobody came in they were stuck on the lower wages, so they effectively signed new contracts. Some did it as a deferral. Others I think did it did it on the basis that they would go back to the original level when the club was out of admin but without the knock down release fees (and this would be mainly players from the British Isles). Not sure about Green trying to force the same kind of thing again, I've only been looking at the situation for the players who want out rather than the others who are staying. He's probably been tryiing to get the last group and the deferrals to agree to some lower terms now they're in D3 though.
Scroll back...Aluko's contract expired on 30th June...he refused to sign a new contract, so he is a legitimate free agent )
I don't think we've got anything to worry about with this signing, Aluko was out of contract, there can only be an academy compo claim and as Rangers are now a different company and he never actually went through their academy, the chances of them bothering with any action are slim, particularly as the numbers are so small.
