If Evra is CERTAIN enough to announce it to the world that Suarez said it TEN times I find it hard to believe it won't have been picked up at least once.

On the subject of the man who tried to sue and failed you may well be right about keeping the floodgates closed but I think part of the difference here is that Evra has announced this to the world as fact without yet providing evidence and I presume before alerting the proper authorities to it added to the fact that he's made similar unproven allegations before. I'm pretty sure unless proven then Suarez would have a fair case for defamation of character.

If someone shouts out unsubstantiated claims about someone it's called slander, pure and simple. Evra is saying Suarez is a racist so he'll damn well need proof. I can't go to the media saying SAF touched me up without some damn good evidence, or SAF could sue me for damages to his "fine" reputation.

I don't think anyone can sue without being the party who was slandered against. I'd be very surprised if Suarez gave any of his sponsors legal permission to sue on his behalf - he would then effectively be putting his reputation in their hands if they handled the case badly. Liverpool might be able to sue, but again I don't think an employer can sue on behalf of their employee.

Probably Although ****** has by now effectively become an international word understood in all languages, so I think it would have been pretty clear *if* he said it.

The woman who falsely accused the man of rape also failed to provide any evidence (I think the case was dismissed with prejudice against her after she admitted in court that it was all lies). And given that the racism was allegedly reported to the ref at the end of the match, Evra didn't make his claim in the media before making it to the officials. Also, regarding Evra's earlier allegation of racism, it was proved that the Chelsea groundsman called him a "****ing immigrant", which was what Evra accused him of, so that wasn't an unproven accusation, just confusion over whether prejudice against immigrants classes as racism. If you want to argue that one, I hear the BNP are always up for it

Slander requires that the claims be false, not simply unsubstantiated. Evra could only be convicted of slander if it can be shown that his comments are without basis in fact. In other words, if you could work out every word he spoke to Evra during the match and show that none of them were racist.

 

I'm fed up with this whole thing.

 

One thing I've learnt from this is that if I ever need any legal advice I'll be paying Swarbs a visit

I haven't read all this thread but it seems there is actually some people defending the use of the word. Get a grip there is no space for this in football or anywhere else for that matter.

I'm not saying Suarez is guilty as I have no idea so don't get me wrong but some posters defending him even if he did are a disgrace to your club. Calling Evra whiny etc- IF he has been racially abused then he has every right and should complain.

I doubt anything will come of this however.

Dont think many if anyone would seriously defend suarez using it if he has as claimed. One of them is well out of order and whoever is lying in this case will rightly deserve a lengthy ban.
