Tbf most pens are questionable now purely based on how players exaggerate and make the most of challenges so even blatant pens don’t look as much so due to this. I don’t think either were really pens but was just playing devils advocate with going by the letter of the law with Arsenal’s and the encroachment

I think you can make a case both ways. On balance I think the current wording is right. You shouldn't have the right to foul someone without penalty just because he is offside. But if you foul him in a challenge then the offside comes first.
I think the right approach would be: If the defending side encroaches, a goal should be awarded whatever happens to the kick; if the attacking side encroaches then it's a goal kick whatever happens to the kick. If both sides encroach then whatever happens stands. That should effectively prevent encroachment.
