As you say it is not oxymoronic as it doesn't directly contradict itself (e.g. the living dead) but i believe it is erroneous as it is wrong and untrue. I also sense a hint of sarcasm in there aswell
the whole thing reminded me of the famous us presidential speech by nixon when he said: "I am not a Criminal"
