Im not discussing that bit, I am discussing where her responsibility for her actions stops. At the first sip of that glass of wine? After 3 bottles? When she pours more of it over herself than down her neck. When does a person lose the ability to make a decision and the alcohol makes that decision for them?
No, her decision was to get so smashed she didnt know what was happening. Had she not then she wouldnt of been in a situation for people to rape her. Some people seem to be of the opinion the world is a nice place and people are only helpful so you shouldnt have your wits about you and maintain self control. You are wrong. If you cant look after yourself there are few who will.
It applies to both parties. Many rape cases like this do involve 2 drunk parties and neither usually remembers much.
The vast majority of rapes are thrown out of court for exactly reasons like this or similar reasons. Also 94% of rape takes place between Friday and Sunday between married or co-habiting partners. Some interesting stats here Conviction rates against reported rapes have fallen dramatically â 32% in 1977, 24% in 1985, 17% in 1990, 7.5% in 1999, and 5.6% in 2004 (Kelly, Lovett & Regan, 2005), 5.7% in 2006; 6.5% 2008; and 6% in 2009. So in 2009 94% of reported rapes end with no conviction I just pulled this off an old powerpoint slide I had on my computer.
One of the drunken Parties woke up some hours later not knowing what happened. Another of the Drunken parties turned up at the hotel uninvited, lied their way past the receptionist into the room, and left immediately after having sex, exiting by the fire exit. Guess which one did which?
Ive never said Ched wasnt guilty. I am arguing that prevention is better than what happened here. The whole situation was preventable.
Interesting stuff. I wonder why rape convictions have fallen over the years, DNA evidence is easier to find these days so maybe if they dont find it a conviction becomes less likely?
It'll never be prevented. Drunk or not rapists will rape. Rapists motives are not sexual in nature, it's about power, dominance and control. This is great article (one of the most recognised articles in the field, unless you read Susan Brownmillers book or the opposing Darwinan book by Thornhill and Palmer. But as far as articles go this is one of the best) http://www.law.northwestern.edu/jclc/backissues/v101/n1/1011_171.Bryden_&_Grier.pdf
True but these kinds of rape cases are easily preventable. Woman doesnt get smashed Man doesnt get smashed. Both have self control and ability to make decisions. They meet in street, no rape occurs. A little crude but essentially the case. Maybe pubs and brewers should take some of the blame aswell. They should be able to recognise someone who is beyond drunk. Not sure how they could deal with it but maybe have policies where they call for taxis or something. Even have the ability to go through their phone to find a contact number for a relative. In situations where women are raped and are not drunk, thats impossible to stop, unless someone invest barbed **** wire or something. Unlikely as it is.
In this scenario you're probably right. However, 95% of rapists are serial in nature. So if Ched hadn't have raped this time then he would of at a later date presuming he's not in the 5% that are opportunistic in nature. Another stat for you - 1 in 4 women get raped (or at least an attempt) in their lifetime. That's an American study (as most are) but pretty ****ed up all the same.
Thats really ****ed up. On the otherside of the coin I wonder how many men have technically been raped while too drunk.
Let's all go round to UIR's house and rape him. When it goes to court we'll say it's not our fault, he chose to act like a prick on the internet and he's reaping what he's sown, also known as the UIR defence. You could have chosen not to talk pish on the internet, but you did, so take responsibility for your actions
I dont often come on GC but from what I know of it you are likely to be raped any moment if the above post applies to yourself.
Please never come back. Your pathetic points in this case are really out of order. You're defending the actions of rapists
Did I? Or did I say if people dont get stupidly drunk bad **** might not happen. People should take some responsibility and the world would be such a ****ed place.
By attempting to apportion the blame for rape on drunk women you are saying the Rapists were not totally at fault. There is only one party to blame for Rape, the rapist.
Ok, try and understand the difference here: If you're drunk, fall over and smash your teeth, it's your fault, agreed? If you're drunk, some other drunk guy comes up and punches you in the teeth for no reason, is it your fault for being drunk? (No) If you're drunk, walking home and someone rapes you, is it your fault for being drunk? (No) Please feel free to add anything
