Unless there mitigating circumstances we don't yet know I think that's a mistake, anyone doing that should face the full force of the law. As weak as it often is.
As said there may be mitigating circumstances but next time it could be you or I on the receiving end and may not be so lucky. Not long since a city supporter passed away who was a victim of just one punch.
Surely it's in the public interest to prosecute plebs like this, and given there's CCTV in the pub, it should be an option to the police to do so even if the Coyle's don't want to.
It wouldn’t be up to the police, it would be the decision of the CPS. The OB have obviously presented the evidence ( CCTV) to the CPS who have authorised a charge of Sect 4. PO. This would imply Tommy hasn’t made a formal complaint. Clearly the CPS don’t feel it’s serious enough or in the public interest to prosecute for assault without a complaint. I’d have thought Affray would be better suited but it is the CPS we’re talking about.

Yeah hes a nice guy who has been assaulted. The law is taking its course, no place or justification for violence like that. Some posters need to take a step back before the unsubstantiated accusations are made.
His assist for Belloumi was a lovely crisp first time pass. I was a fan of Mehlem, I was disappointed he wasn't given more of a chance. I'd be surprised if Paderborn don't take what will probably be a pretty cheap option, maybe wages will be an issue, not sure what he's on at City.
Don't the CPS have the ability to upgrade the original charge to something more serious(if they review the evidence and decide to) down in England?
Why would they review it though? End of the day and in the grand scheme of things it’s a low level assault in a pub. If the victim changed their mind and decided to pursue a formal complaint then that would, indeed, be a different matter and more serious charges would be sought. Mind you, the CPS would probably bottle it and downgrade it to a section 5. PO.
I'm not really sure how it works in England,that's why I was enquiring. The procedure and law is different up here obviously but the charge was made very quickly on initial evidence handed over by the police,(it's rare to be charged so swiftly up here,unless it's the police who've actually caught you red handed, because the police will dig deep into a case before presenting 'all' the evidence to the procurator fiscal).If the police in this particular case were to decide it was a bit more severe than first thought,can the original charge be altered to one of a more severe consequence?
I believe under certain circumstances, mainly introduction of fresh evidence, but I think the case involving Tommy will be cut and dried. Also a different matter if his medical condition deteriorates or he decides to press charges. As it looks, he’s not making a complaint and the CPS have gone for the lower end of the charging scale to secure a conviction.
