My opinion may be flawed but it's a statement of fact that its my opinion. Depending on what Angus Young meant when he said it was "tough viewing" watching the cross examination the tribunal may well come down on the side of the SMC.
tbh they know which way it will go .. and end up in him saying "I know I fight for what is right" ,, they have drianed the gofundme money and just letting it drain nicely , instead of fighting they would have had money to set them up .. but they persued it against the dickhead ... they are left skint and he walks away smug ... end of case
nah - another nail in the coffin of the Allams - pariah's of Hull - no-one likes them, waiting for the day Allams name is removed from the Allam Building at the University, he'll want his donation back soon, it was only a gift which means it has to be repaid on demand
Didn’t you say that you thought the SMC would resist an unfair dismissal charge? Something they tossed in before the tribunal even started.
They can’t just keep the money raised ffs, people donated specifically to fund a legal action and that’s what’s happened. They’ve been vindicated, the case of wrongful dismissal has been proven, it’s now s case about compensation. They were skint when they started, tomorrow they'll find out if they’re still skint, or if they're being compensated.
I did. The SMC gave in on a technicality, Ehab hearing the appeal having made the original compliant. Thanks to the 2010 coalition government that mishap on his part is basically irrelevant. The Tribunal will decide whether one of the groundsmen working for Hull FC was a sufficient breach of contract to deny them any compensation for the unfair dismissal. The Tribunal saying its unfair dismissal and them getting no compensation is a pyrrhic victory, in my opinion.
Ehab completely misread the situation, he was banking on them not raising the money required to fund the action, he was always going to be in bother if they did as they were quite obviously wrongfully dismissed.
It may be quite obvious to you but I still think there's a very good chance they'll end up with no compensation, despite being unfairly dismissed.
In terms of the online fundraising he was right, but they've been backed by an individual. I don't know who. Ehab's problem is the Allams have spent so long making enemies in the city and now it's coming back to bite him.
Just reading through all what has been said over my night, unless I have miss something, it seems strange to me that one the one hand SMC have conceded that they were wrongfully dismissed. But on the other hand saying now that Darrell was working in their time for another outfit. Surely that is a dismissable offence working for someone else in company time, so why concede they were wrongfully dismissed?
I think they’ve conceded that the process they used to dismiss the two was wrongful. But they are claiming that if they had followed the right procedure, the SMC would still have come to the same outcome, which affects the compo on offer. It’s all about the money now. They are effectively having a second bite at the cherry.
Ive read it as dismissed wrongly rather than wrongful dismissal, if that makes sense. Ah yeah like Als said.
