If you want to go to extremes you could claim it as being in the interests of national security. By stopping him suffer heart problems later on you're saving the nhs money, which saves the government money, which can be spent providing the military with the correct equipment for the conflicts they're in.

The preemptive self defence is valid though. So long as you can legitimately claim that the other person's actions lead you to believe you were about to be assaulted if you didn't take action, then you're entitled to take action. If someone is pissed up and being aggressive towards you it's reasonable to think that they could be about to hit you, so you're allowed to prevent them so long as the force used to do so isn't excessive.

There was a programme a few years back about reasonable force. It surprised me just how far you can go as long as you justify it correctly. I think it's changed since then too as in the right situation, there's now no over-riding expectation for you to walk away if at all possible.

One guy got away with using a golf club to subdue a burglar another was found to have used reasonable force even though he'd kept on hitting the burglar when they were on the floor. His argument was the burglar was big and still twitching, so he feared for his own safety if he let him get up. Both were in the home though, which makes a difference.

why is he Lucky ? the man does not have the brains to be a tax evader. maybe its his accountant that should have been in the dock ? yet another H.M.Customs Revenue cock up and the tax payers foot the bill for all this. <cheers> :mad: :mad:
