They've probably been told to hang fire until the trial is over by their lawyers. If it takes away any possible source of appeal then we should probably be grateful for that.
They will be discussing this with their lawyers and they have to make sure that they do two things: 1. The 'right' thing 2. The legally correct thing. I wouldn't bet against a lot of midnight oil being spent at their law firm over this matter. If one is going to cut someone's contract for unacceptable behaviour without the workplace then you have to make sure that you have every legal avenue covered.
