Exactly. Im not saying it always leads to a charge but if you're innocent and can explain it then you should have no problem answering the questions. it infers guilt in my eyes. Talking from my own experience of being questioned by the cops after being nicked, it would go something like : "Mr Johnson, have you engaged in sexual activity with ****** ******?" "No I haven't". "Mr Johnson, are you sure you have not engaged in sexual activity with ****** *****?" "Absolutely not". "Mr Johnson, I put it to you that you did engage in sexual activity with ***** *****. Is that correct?" "Not all all". REPEAT AD NAUSEUM "Mr Johnson, it's a lovely day today isn't it?" "Yes, it is". "Mr Johnson, you must have enjoyed your hat-trick against Fulham". "Yes, I did". "Mr Johnson, what did you eat for breakfast on the day of the alledged offence?" "I can't remember, but I always have a light breakfast as I'm a professional footballer". "Mr Johnson, what did you have for lunch before you engaged in sexual activity with ****** ******?" "I had pasta with tomato". "SO YOU AGREE YOU ENGAGED IN SEXUAL ACITVITY WITH ****** ******". And this is exactly why every brief in the land will advise a client to not answer the police questions. If AJ did this he deserves everything he gets. But innocent until proven guilty as many others have said, it could all be much ado about nothing. All of us are only speculating.
Good job the law doesn't work that way. Any brief will advise a no comment interview at the first stage unless the police have evidence to present to you, it's standard practice and legally not an acknowledgement of guilt. I've been wrongly arrested and given a no comment interview and the truth was later proved to be someone else. Inferred guilt did that did it? You don't know what you're talking about mate. If there were more people like you then Innocent until proven guilty wouldn't exist. No comment interviews are designed to protect that liberty. If you ever get arrested for ffs get a brief before you talk to them fella. The CP don't care if you did it it or not, they only care if they can pin enough to you to charge you and they will do it on circumstantial evidence hence why so many innocent people get charged and dragged through courts before being found not guilty. Seriously mate, you'd be your own worst enemy if you got nicked, you must get representation as the CP pray on naivety. They'll be nice as pie and let you hear lots of reassuring things if they think they can get you into an interview room without representation. The important thing to remember with the police and the CP is that's it's a results based industry. What's right and wrong doesn't come in to it, that's what the courts decide. It's all about the figures and the more charges they can bring(regardless of the final outcome in court) The better their figures look. It's down to them to prove your guilt, not you to prove your innocence. It's like that to protect us. Never throw away your liberties.
