If the EFL just decided to disqualify them from the final, Southampton’s lawyers will likely try to get a High Court injunction to prevent the final from going ahead entirely. The EFL would probably have their decision declared ultra vires and thrown out.
However, the EFL would have a stronger legal argument to declare the first leg forfeit in favour of a 3-0 victory to Boro, given that the spying offence was in relation to that particular match. This would mean Boro win 4-2 on aggregate. Therefore, Southampton are not expelled or disqualified from the final but rather they lost the semi-final on aggregate.
