    Nah there’ll be a contractual obligation otherwise they’d be useless. Buy-backs are triggered often just to sell the player straight on for a bigger fee

    And he could decline that move, surely?

    Do we even know for sure there’s an active clause? Makes the new deal a folly surely?

    He could decline the move to Brighton as it’s a new transfer but he couldn’t refuse the buy back to Spurs as it’s already a negotiated clause. Cirkin will’ve agreed to the terms when the transfer to us was arranged

    Yeh Cirkin can refuse any transfer back to spurs, whether to loan him further or otherwise.

    The buyback clause is literally just a minimum fee release clause that applies only to spurs

    no, that’s not how they normally work. Because there’s no way at that point of anybody know when or what level he will be at when the buy back is triggered

    It wouldn’t make sense for Cirkin and Spurs to agree to a hypothetical contract and wage without knowing when it’s going to be triggered.

    the buyback clause just gives spurs the right to buy him at that price, but Cirkin has to agree and sign a new contract with them.

    the deal is purely between the clubs, not the player

    Yeah that’s why there’s a time limit on it. They can’t just say well we can buy him back at any point in his career for X amount of money.

    It’s an agreement between the player and both clubs when the transfer is arranged that the selling club can re-purchase for a set fee within said period and he’ll rejoin on t&c’s that were agreed with him at the time ie better wages, length of contract etc literally as if it’s just a new transfer.

    If there was no contractual agreement then the buy back would essentially be useless and buying teams would always agree to them because the selling team would have no power whatsoever to trigger it.

    the selling club (spurs in this instance) are confident enough that they’re a big enough pull that if they want Cirkin back, he will come.

    it’s not useless - it means if he becomes a £12m player and wants to move to the premier league - they get him for £6m instead of £12m.

    they’re gambling on him wanting to come back. But they’re basically just negotiating themselves a low release clause

    It was just journos and 'reports' about a buy back, don't think anything was confirmed by the club. Not sure if he could turn down the subsequent transfer or not but the way I read the buy back clause is; for the right price, he is a Spurs player. But this buy back will have an expiry date, 3 years, 5 years? Not a clue how long it last for.

    Was said on here and RTG and accepted and spread as gospel.

    Didn’t the lad desperately want away from Spurs/London for some personal reasons as well? I’m sure this rings a bell.

    The lad could piss PL now by the way.

    Pretty sure it just means the club will be required to accept the offer however it’s totally down to the player to agree.

    No different to any other transfer where there are two separate parts, club agreement and player agreement.

    Think these things usually have an expiration clause.

    Tried finding something on it but nothing much official coming up other than this which is obviously in Italy.. it’s definitely enforceable though it makes absolutely no sense whatsoever for the selling club to insert a clause to buy a player back on the cheap if they have no power to exercise it.

    If that was the case you could envision Cirkin walking out of the meeting with Daniel Levy after agreeing to the buy back clause then giving him the ****er sign like Jay off the inbetweeners as he drives away :emoticon-0102-bigsm

    Under Italian Law, buy-back clauses are valid only on condition that:

    • the transfer agreement contains a fee for the grant of the buy-back right and a fee for the repurchasing of the transferred player;
    • the buy-back clause is signed by the player including an express declaration accepting any consequences of the exercise of the buy-back right;
    • the selling club signs an economic agreement with the player for a minimum duration of two sporting seasons, counted from the season following the one in which the transfer took place;
    • the buying club signs an economic agreement with the player for a minimum duration of three sporting seasons.
    A buy-back right can be exercised by the selling club with effect from the first or second season after the one in which the transfer took place.

    The buying club is also entitled to transfer the player’s contract to a third club temporarily or permanently, but only with the consent of the transferred player and the selling club. In any event, if the player is definitively transferred to a third club, the ‘buy-back right’ automatically lapses.

    A buy-back right is a very important legal provision that allows transferring clubs to sell promising players (who are, however, in many cases, too young to play regularly for the club) to other clubs where they will be valued, knowing that those players can be repurchased at a fixed price, without the risk of losing a potential talent.

    Have done some reading on buybacks and to clarify:

    1. It's unaffected by this new deal Cirkin has signed; it's a completely separate contract between the clubs only.
    2. As a result of 1, even if Spurs do activate it, Cirkin has the final say whether he wants to go back as he is not party to the "buyback contract" between the clubs. If they can't convince him, he stays [EDIT: This might be wrong, different sources say different things. I think it depends on how the deal was structured?]
    3. The Sunderland Echo reported that the buyback clause expires on 30 June 2024. No guarantee they're right, but it would make sense. That gives Spurs three years from Dennis signing with us which seems like a fair compromise for all parties involved.

    It'll definitely have a time limit on it, otherwise he could grow to be worth well in excess of that fee and Spurs could sweep in and get him well below market value. Not a chance we'd be silly enough to agree to that.

    We should, but it’s something they probably wouldn’t agree to because it’s not within their interests it suits us and Dennis. They know they have another year or so to evaluate him and can re-sign him for a snip of what he’s potentially worth then decide to give him a chance or sell him straight on.
