Are Pre-Contracts binding?

The enforceability of a pre-contract will depend on the specific terms of the agreement. Pre-contracts are generally not binding under English law as they are usually marked ‘Subject to Contract’ and are simply a commitment by the parties to enter into a later contract. The difference between a pre-contract and a contract is that the parties to the pre-contract have not agreed the essential terms and so the pre-contract does not reflect the final agreement.

What I've picked up by reading into it is, the contracts don't usually become binding until the player has had his medical, which the club won't let them take until the time that they actually sign, incase they get injured in the interim period.

Makes sense, at least it shows that we want him and he wants the move.

But feelings fade away with time. That's my worry.

Anything could happen, all it takes is a club in European competition to come along and offer him decent money, and his agent, of course. He could well sign for somebody else. I'm still 50/50 as to whether we will get him.

Bea-****ing-utiful. When this comes off it'll be one of the biggest, most significant signings in our history. He's a class player and a great bloke who already has us all eating out of the palm of his hand.

I am withholding further comment on Yann as I feel I may be creating the illusion of being in love with him.

I think it's fairly water tight, the reason I say this is because no other club gave him any real significant interest in the window. That said to me that we have this one covered.

Having said that if both parties changed their mind they could easily get out of the deal. For me it's down to Yann, if he wants to come then he will. If not we would not want a player who was not committed to the club anyway.

Just read this and my mind went back to Jack Colback and his move to N/C.

The Press reported that after he signed a pre-contract with N/C, West Ham made him a better offer.
He tried to get N/C to drop their interest but they insisted that they would only do so if they received £5mil.
West Ham were only interested in a free transfer so he ended up at his 'boyhood dream club'.

IF my memory is correct and IF the Press stories were right there must be some basis to pre-contracts, if only through UEFA backing?
