I understand you can't completely remove risk, but I would assume a risk assessment for racing a open top car would identify that wearing a helmet would lower the risk of serious injury should the car have flipped.

We are having this debate on here and in all honesty the BBC might have paid him the cash as a "we feel bad payment" and there might have been a risk assessment and he might have been advised to wear a helmet we don't know.

In terms of health and safety these days you have to tell people everything to cover your own back. People can be thick and these days you get a nice payout when you are if your employer hasn't told you not to be thick!

    Good points.

I wonder if he had insurance to cover injury, loss of earnings, etc, in the event of an accident ...

... if not why not, it's negligent on his part if he didn't bother.

If he couldn't get insurance, there's your answer ... he shouldn't have driven the car at all.

And if he did have insurance why did the BBC have to pay.

Would insurance be covered by the BBC?

Depends if they he was down as Ltd company for some tax perks. Highly likely!

Presume they would have had some kind of Liability cover particularly for every outdoor broadcast and specifically for such a programme as Top Gear.

Yeah. You will probably find they have got millions in insurance money with the show being cancelled after the accident.

Ive never understood how Top Gear have getting away with it for so long. The programme totally encourages idiots to drive like ****s. I bet that bloke who filmed himself doing about 130mph losing control and killing that young mother and her unborn child and leaving 2 kids brain damaged is a huge fan of the show. He got his sentence increased from 12 to 15 years yesterday. He shouldnt be let out as far as im concerned.
To me its comparable to a tv show where b list celebs try different mind bending drugs, injecting themselves with all sorts and showing the after effects of them having a really good time going on all sorts of trips. A right hoot. Impressionable kids at home thinking it looks a right laugh and give it a go! However the programme doesnt show that years later Rylan's in rehab, Vanessa's septum has dissolved and that bird from Emmerdale is now HIV positive!

Whole programme is a bit off to me like.

Blokes behaving like teenagers let loose with their dad's cars.

But they all play the macho part, so why any of them should pocket millions when it doesn't work is beyond me.

Agreed mate. Absolutely. But from speaking to my mates in the service, they all reckon, with the reports, that he’d have died with a crash helmet on. All conjecture of course as we’ll never know.

It all reminds me of when these 'explorers' go on a walk across the Arctic and say 'One wrong move and we could plummet into a crevasse and die' ...

... I don't admire them in the slightest, I just think 'Don't fukin go then you tosser'.

Yep. Or when some wildlife dud is 20m from a lion. “If he knows I’m here, then I’m done for” when there’s probably someone with a 12 gauge trained on it!

Whoever would've guessed you'd be in danger camping in an area populated by huge predators <doh>

The worst thing is they usually go out and shoot the Polar bear, tiger, lion, Hippo, Shark, Alligator or anything that moves because it’s dangerous,
