The jury wouldn't convict for assault on the male officer, as he's the one that kicked them in the head, I doubt a retrial will change that.
How can you possibly know the reasons why they couldn't reach a verdict...He never kicked 'them' in the head,he kicked the skinny **** in the head,prior to that both he and the elder brother had assaulted the policeman..
I'm fairly sure the CPS have got a better insight into this than you or I will ever have but don't let that stop you making ridiculous assumptions.

Did the “ assault “ not take place before the cop put the kick in. A fresh thinking jury may think differently.
Could both sides be guilty? Just because the copper kicked the bloke does not mean he cannot have been assaulted by the bloke earlier.
