Yes, I thought that's what we were talking about too. And according to Inter, SAFC are responsible for the player. They are claiming that from the final whistle at the Emirates, or from July 1st if that's how the agreement was worded, their contract was voided by Sunderland's prior written agreement to buy him. And if a SAFC-Alvarez contract has not yet been issued it's entirely due to Sunderland's breach. Whether they are right or we are remains to be seen. The hearing will decide that.

No mate, mutual agreement must have been made, otherwise the loan contract could not have been made containing the terms it apparently does. But does it? - We don't know that yet. The hearing will decide that.
 
So Inter and Sunderland are fighting it out in court to argue that the other person should have him as they don't want him and Roma "make enquiries as to his availability". I'm going to go out on a limb here but I think he's available, what response were they expecting?

Basically mate, obviously with out the details which we don't know and which will make all the difference and will be analysed in court. Ricky picked up an injury that needed an op, Sunderland ask Inter, the players parent club, for permission to operate or we'd lose him for last half of the season. Inter refused to give permission and we'd have to play on with him. He later broke down completely, Sunderland claim the terms of the loan were voided as Inter refused treatment which in turn could achieve permanent damage, so we tried to agree a lower fee. Inter again refused so we said the whole thing is off. Now inter want to force the transfer. In the meantime since the season has ended, inter have thrown the lad out into the cold, still no op, no training nothing, claiming that he's now a Sunderland player despite the transfer never being complete as the player hasn't signed a contract with us and we haven't paid them. This thread is about who's responsible for the poor ****. I believe he's still Inter's responsibility until the court rule otherwise as there only player contract currently in existence is his contract with inter and because article 13 Respect Of Contract in the Fifa Regulations on the Status and Transfer of Players.

Agree about Inter's behaviour with regard the operation, and I've already said I think they'll get caned for it. But with regard contracts, they're claiming that player contract isn't currently in existence and hasn't been since the Arsenal game.

For that have happened Ricky would have become a free agent. you keep intertwining player contracts with club to club transfer contracts, they are separate things. The thread is about who's responsible for Ricky now. that lies with who the player has his contract with which is 100% inter. We know this because a player can't enter a pre contract agreement until he's in the final 6months of his contract. This means by fifa law we could talk turkey over a playing contract until the end of the season regardless of the transfer agreement, but we'd decided we didn't want him well before that. That's why we know there's legal obligation on our part to the player until the court rules otherwise.

One the transfer front. It may not look good for us, but as far as who is presently responsible for the lad there's no doubt in my mind it's Inter. They have the only contract in place with the player. If Inter win they'll take damages for wages, but refusing him treatment and training is bang out of order. It's taling the clubs disagreements out on the player. Really feel for the lad.

Exactly... and that's all it is at the moment, a claim. Until a court rules otherwise, he's still Inter's player.

Well the're wrong imo, They'll get their hands slapped on it. Hope Rickey sues them. Inter should have just looked after him until the court case was over and take the damages from us they would be entitled to.

Shooting themselves in the foot anyway, if they give him his op now they A get the money back for the op, physio, training and wage from us should they win. Or B. If they lose they have a player they don't want on the mend putting themselves in a position to sell him for optimum price. They won't get an optium price trying to sell a player who needs an op

As I believe there was a contract in place containing a black and white agreement that he signs for Sunderland should we stay up, I still reckon we are going to be forced to sign him. With Inter's refusal to allow treatment and us already offering a lower price, I also believe the court will rule in favour to Inter that we have to sign him but because of Inter's ****ing about it will be a reduced price, that's about as much middle ground there is to keep both clubs happy.

Sounds about right to me fella, unless inter's refusal to give permission for op violated the agreement of course. Which will also come out court as that's part of our case so we should hear the crack there. In the meantime the poor lad is being **** on by Inter. :(
