The filth that is the Bristol Green Party, disguised as Traders and Residents Against Supermarket in Horfield have applied to the High Court for a judicial review against the decision to grant Sainsburys planning permission at the Mem.

These vile sacks of **** - the likes of Radice and Hoyt are not even ****ing Bristolians, yet they're doing everything to hold our city back.

First BCFC, now us.

I despair about my home city, I really do.

Now it could be months on end before we can start building.

And to cap it all, these ****s have formed a limited company to limit their liability for costs when they lose, leaving the taxpayer to fork out again. This just can't be right.

We have received news that an official Judicial Review application has been lodged with the High Court.

The application, on behalf of TRASHORFIELD Limited, questions the validity of the planning permission granted to J Sainsbury’s on the current Memorial Stadium site.

Written legal representations will now be made to the High Court, which we hope will be reviewed within the next ten to twelve weeks, and the High Court judge will then make a decision on whether to proceed to a full-scale review.

Whilst we are massively disappointed that a JR application has been submitted, we urge supporters to stay calm as we work through this with our partners.


BB, you might as well rename this thread Backward Bristol! First City have had to do an about turn on Ashton Vale because of a small nimby minority and now some tree huggers are doing their level best to stop Rovers plans. ****ing sickening. Just close both clubs down and leave Bristol football in the history books, that'll keep them happy.
 
Perhaps we should all write to Eric Pickles and demand that he persuades the decision makers to act quickly. At the moment the legal costs to TRASH are not too high, but must be raised by themselves.

This now seems similar to the case where the Green prats objected to the completion of the last link in the Ring Road around North and East Bristol. Local residents had to tolerate months of traffic making rat runs thro our country lanes, for objections made by the 'desert welly brigade' who claimed legal aid to support their case.

I suppose we will get Caroline Lucas joining in the debate if she feels it will promote her image. If she doesn't come on board you can be pretty sure they won't expect to win!!!
 
No point in writing to Jabba the Pickles Sapphire, it's a judicial matter not a legislative one.

This kind of crap is exactly why Bristol has no Arena, appalling public transport, crap stadia, can't hold significant national or international events (apart from ****ing balloons), a ring road which isn't, no ice rink, etc etc.

The city must lose out on hundreds of millions of pounds and thousands if jobs because of these ****ing ****s.
 
Spot on bluebaldee, I know you were not one of the ones advocation signing petitions against AV, but a lot of your clubs fans were, and instead of empathy from city fans I suspect a fair whack are quite smug now.

If only the club and fans on both sides had worked together for the better of a sporting city maybe these parasite wouldn't get it all their own way.
 
Delboy, yes, that was shameful. However, it only represents a minority of Rovers fans. The ones I know, and most on here, have a rather more mature and non-partisan attitude towards City's attempts to build a stadium. At the end of the day, I just want both clubs to have the modern facilities that would enable them to compete in the 21st century.

I think it's the idiot element in both clubs that can't see the wider benefits to the city of having decent football stadia for both clubs. Many are probably too young to know better (no offence to sensible young 'uns, and especially Shiny!).

I'd like to see supporters from both clubs get together, put their differences aside for a day, and have a 'March for Decent Stadia', leaving from their respective grounds and coming together at College Green to let the idiots in the Green Party know how we feel.
 
I'm going to remain optimistic.

Obviously BCC legal guys have left the plonkers a loophole which allows them to make their complaint against the legal procedures of the planning decision's approval. The Greens were obviously aware of this technicality weeks ago when they sent their 'Letter of Intent'. Meanwhile they have been raising funds to pay for their legal action.
So why have they left their full application to the last minute?

Probabilities;
1. They haven't yet collected enough cash to fund an appeal against the judges decision to reject their claim which he most likely will.

2.They know that they are going to be rejected by the High Court judge and that they have no intention of pursuing the case further as they are aware that they will lose any further action. So in the true spirit of the Greens, they are causing the maximum amount of delay and disruption to the process which they feel will earn them Brownie (or should it be Green) points with their supporters.

I know it's supposition, but I reckon point 2 is closest to the reality.

Addition. The Greens may also feel that there is some mileage in the fact that Steve Comer, ex Leader of the Lib Dems on the BCCouncil, who swung the vote in Sainsbury's favour with his impassioned contribution, lost his seat in the last elections!!

Planning decisions can be challenged in the courts if there is evidence that the process by which the decision was made was unlawful.

Since there is no right of appeal for third parties on planning decisions in the UK, judicial review provides the only opportunity for further action once a decision to approve development has been made by a local authority. However, it can only consider the lawfulness of a decision and test whether it was legally right or wrong. The best outcome is that a bad decision will be quashed and returned to the relevant authority who must then make a fresh decision. The same decision may be made by the LPA again as long as it is then made lawfully.

All the correct procedures were followed in the planning application and the final approval so my guess is option 2 offered by Sapphire is probably the most likely.

Gas, I agree with both your and Sapphire's conclusions. However, it now means that the build will be delayed until probably after Christmas, it means that all parties (except the scum TRASH) will be burdened with more costs, the taxpayer will have to stump up more, and most importantly, it introduces an element of uncertainty into the whole project.

Look at what happened across town. A couple of Nimby's managed to persuade an idiot barrister that a tip should be a town green and four years on they're still nowhere near a new stadium.

I just ****ing hate them. <grr>
 
The councillor interviewed at lunchtime on Points West just rehashed old arguments
which have been listened to and dealt with.
However if this request for a JR is to do with procedure, I hope that what I read elsewhere
about plans for an access road being altered after a specified date is wrong,
for then there could be problems.
 
Hmmmm.. Can't say I'm surprised by this and I would warn this, don't assume that this will just get rubbed away as if by magic and digging will commence in a few weeks, because I doubt very much it will.

It is very tempting to drop to the level of many Rovers fans who actively campaigned against our stadium bid for no other reason than pure jealousy. Remember it was CJS who started a petition and encouraged people here to sign it, proclaiming that he was unable to afford an additional 10p a week in local tax towards it! I wonder if you have reaped what you have sown here? All this faux protesting has given the nimbys and greens the encouragement they needed (and some apparent success) However I do find it all rather sad that we are just so far behind other cities in our general ambitions.!

Shame indeed.

One of the arguments at the open debate was that the application had not been properly discussed and researched with the local residents. If I remember correctly it was the Sainsbury's representative who rebuked those arguments. The procedural error P49 refers to is that an application regarding the access road was entered three days after the closure date 8th January. And had not been adequately put to the public for comment. So it would appear to be a technicality, but a pretty minor one.

Banksy, I think you're over-egging the 'Rovers fans actively campaigned against Ashton Vale' thing. There were plenty of City fans who signed the Horfield ROSE petitions when we tried to redevelop the Mem before that went south. And when it did there were plenty who were rubbing their hands with glee. Equally, I'm sure there are many City supporters delighted at today's turn of events.

Unfortunately, there will always be some on both sides of the divide who resent ground development for either club. As you know, I, and many others don't fall into that camp as the benefits that accrue for the City of Bristol should outweigh any daft partisan point scoring. <ok>

God knows the city needs it. Is there any other comparably-sized city in the UK without decent stadia, an arena, ice rink, non-First-bus based public transport, conference facilities etc.?

Short answer: No.
 
BB, I fear that the people like yourself who can see the bigger picture are in fact a minority not the majority.

I wish you all well but fear that the argument that Gloucester Rd will benefit from another supermarket wont fly? I'm surprised the council even gave permission after the Golden Hill shenanigans less than a mile away.
