Paying him and letting him go to West Ham would be an advantage to another Premier League side and none to Spurs.It's probably a negligible difference in the end to be honest. Either paying and letting him go on a free or paying to terminate his contract.

Why would the club agree to that? Pay the money and benefit another side or pay the money and don't benefit another side? Pretty simple.
You're also assuming that there was nothing in the pay-off agreement that would stop him signing for another club.
