Its suppose to be innocent until proven guilty but in modern society its guilty until proven innocent. Unfortunately that is now the way of the world because of the introduction of technology and particularly social networks that give all and sundry a platform in which to air their views (bit like were doing on here right now

It shouldn't be tricky at all though. The court ruling for someone being guilty is supposed to be 'beyond reasonable doubt'. In other words, to convict someone there shouldn't be any reason to suspect they could be innocent.
In a situation where its basically one word against another with no possible evidence to support either claim (the argument is about consent, they both accept there was sexual activity) it is more or less impossible to have a 'beyond reasonable doubt' conviction. In Evans' case, it was 2 (Evans and Macdonald) vs 0 (she was too pissed to remember) so the fact he got find guilty seems ridiculous really. However, I've obviously not seen any of the paperwork so there is probably things I'm unaware of too.
