I see a lot of people who are against the death penalty tend to use the miscarriages of justice as a justification/reason for not having a death penalty.
Whilst i agree that in cases where there have been miscarriages of justice an innocent person would have been killed, and that would be a traversty, I dont feel that this is justification/reasoning for not having the death penalty.
Its more a reason for sorting out the mess that is the 'justice system' where such misacarriages are allowed to happen.
I know there are exceptions to most rules, however, in the case of the majority of the miscarriages of justice it usually ends in those within the justice system having lied/misplaced evidence or simply beaten a false confession out of the victim.
