I have a problem with this story. The ****er got what he deserved. Free the old fella. A 78-year-old has been arrested on suspicion of murder after a man was stabbed during a suspected burglary and later died. Police were called to a house in Hither Green, southeast London, at 12.45am to reports of a break-in in progress. The occupant had found two males inside his home. The homeowner was then forced into the kitchen by one of the suspects armed with a screwdriver while the other went upstairs. During a subsequent struggle, one of the males found inside the property sustained a stab injury to his upper body, police said. He was taken to hospital but died soon after 3.30am. Police initially arrested the 78-year-old on suspicion of grievous bodily harm but they have since rearrested him on suspicion of murder. A Met Police statement said: "The homeowner suffered bruising to his arms. His injuries are not life threatening. "He was taken to a south London police station where he remains at this time. "The second suspect in the burglary fled the scene prior to police arrival and remains outstanding. "The Met's Homicide and Major Crime Command investigate. Enquires are ongoing." The dead man's next of kin have been informed but formal identification is yet to take place. A post mortem examination is expected to take place in the next few days.
You leave your human rights at the door if you go and rob someone’s gaff imo. Especially if you’ve threatened the home owner with violence and he then reacts. Tough ****.
I have a very big problem with this story. If a toe rag/s enter your home with a weapon with intent to steal or harm it must be the right of the occupier to protect himself or property. Once someone breaks the law in such a pre-meditated fashion they should lose the right to legal protection in event they get hurt or killed. I'm fully behind what should be a change of law to protect innocent people from these scumbags.
Reminds me of a guy who saw two Pikey's robbing his shed he phoned the police and was told they didn't have a car in the area. He phoned back and told them one of them had a gun. In two minutes the place was swarming with police and a helicopter. They caught the two robbers but they had a go at the owner for lying about them having a gun. He said you lied about not having a car in the area.
well if that description is accurate doubt it will even go to court as CPS would rule there was no realistic chance of a conviction i.e. try finding 12 jurors who will find him guilty.
If someone breaks into your house then they’re fair game in my opinion. It’s not like he was lost. If I thought my kids and wife were in danger then I’d be unlikely to take the time to think about how I could reason with the intruder or work out how to apprehend them without using force or violence.
It will boils down to how he killed him, ie if the scum was running away the the old bloke chased and stabbed him then he will end up in jail. If the scum got stabbed in a scuffle then I doubt the CPS will prosecute.
In my old job I used to do what was called 'breakaway' training, which is basically how to get yourself out of loads of different grabs, headlocks, people grabbing you by the hair etc. The law says that you can use 'reasonable force' to protect yourself if you are being assaulted. If the Burglar was threatening to kill him with the screwdriver, and went to attack him then basically it's anything goes and you can use whatever force you like to stop them. But like you say, if the bloke was running away and he attacked him, then it's not reasonable force and he'll be prosecuted.

There is a difference between a burglary and going armed on a burglary, the latter expect what ever consequences come your way. If they went armed with a screwdriver and the old boy killed one of them, tough ****te really.
No difference whatsoever for the old boy being burgled. What's he supposed to do, stop and ask them if they're carrying a tool so he knows how to deal with the situation? Doubt it. In that situation it's plunge and ask questions later.
I'd say that it would be HIGHLY LIKELY that anyone breaking into your house would be armed with "something". The police know this.The law needs to be changed.
The law says you can use reasonable and appropriate force to defend yourself. This is designed so that you don't have people shooting kids in the back when they are running away from your house. (The Tony Martin case, who shot dead a teenage burglar who was fleeing from his house) I know it's an emotive subject, but I think the law is about right. Otherwise where do you draw the line ? Would it be reasonable to stab to death somebody who was homeless and broke into your shed to find somewhere dry to sleep for the night ?
