but SWT award the contract to NR or Siemans, Cleveland Bridge or Serco or whoever its exactly the same. I bet TC appeal and win. They wont do it until the hoohah dies down and will wait until their peak trading period is over. October- November this will be back in court..
SWT award nothing to NR as they're our overall operating boss. I take your point though nonetheless mate, fwiw Siemens build our trains.
I think you are having a mike moment there. NR are the custodians of the infrastructure they are not your operating boss. Thats why you can sue them if problems they create cause you cancellations and delays.
Yes, if it doesn't move on the network then it's their baby as the saying goes ie. signals, track, stations, points etc,etc. However, all other TOC's collectively come under their control as part of how the whole network is made up. There is however an alliance between SWT and NR for a more seamless and coherent working practice and apparently it's working as compared to before the alliance, yes of course any of their infrastructure causing delays or cancellations is down to them, likewise a failed train would be down to us. Have to say that on the whole, it's mostly signal failures that cause most problems, although I don't know if there's an agreed shared responsibility for trespassers or fatalities.
