Well tomorrow is the first time for a while that Mrs Proudman has been on the Bench, albeit with another case. Any chance that she has her office preparing the decision documents to hand to Rovers and Sainsbury this week?
She may need to get her decision checked by an independent third party. I don't know exactly how these things work, but if she has had to write a report in support of her decision she may need some independent legal bod to go through it with a fine tooth comb to make sure that it all adds up. If it is a straightforward decision it may not even need to be checked. If, on the other hand, the decision is contentious or sets a precedent, then I reckon this would take a while because amendments would need to be discussed and agreed. So I think the delay may be a good thing.
If Sainsburys could legally get out of the contract and the contract was not watertight, I believe we would have had a result ages ago. The time this is taking i can only see a happy ending. Lets hope it is this week though.
Its pretty annoying that she is working on other cases. Her head will not be 100% our case and something could get missed which could effect the decision.
I wonder how many days notice do they have to give both parties as both parties will have to arrange to get there to be present for the outcome?
They can always appeal that 'her judgement is not impartial' apparently. Lets hope that the delay has been because she has run her decision past the other judges on the Bench
Naughty CJS, according to my Mrs, Woman can multi task and deal with more than one issue at time. So we should have confidence in the Right Honourable to arrive at the correct outcome in favour of Rovers. Cant be far away now me thinks.
Of course they can multi task. But I doubt they can work out a difficult mathematical question half way through working out a different difficult mathematical question, without getting sidetracked or confused and without missing anything, if you catch my drift.
Of course I cant. Thats my point. How can the judge give a clear sound decision when while in the process of making that decision she is dealing with other cases, learning them and making decisions on them as well. If we win then no complaints But....
I'm pretty sure she doesn't sit at her desk racking her brains and tutting! She'll have a structured way of arriving at the legally correct decision based on case law and contract law, and I'm pretty sure she can do that, with her assistants, for several cases at once. They're pretty clever people judges, that's because they've trained for years and have the intellectual abilities. Having said that, if she does decide against us, I take all the above back and she can go and **** herself.
