You'd think actually owning the spot that you were fined to park in would be a strong enough case in itself!
This is bad advice, there is no way anyone would accept that this. Even if you say didn't receive the original ticket you're often sent two or three more through the post trying to get you to pay early, then you'll receive dozens of warnings and threatening letters before you finally get the court summons. It would be hard to convince anyone you've missed all of those letters but managed to receive the court summons. Plus they'll easily prove the made a reasonable effort to notify you of the charges.
There is no requirement to issue a PCN and put it on the car, fines for traffic offences including parking, using bus lanes etc can be issued from photographic evidence. There is also no point in saying that you have not received the notice in the post. The requirement is only that the issuer has sent it and can prove postage. I use a Bulk Certificate of Postage to prove that I have sent the notices. In 95% of the cases that I collect payment from, the debtor is fully aware of the debt and is simply unwilling to pay. 2% argue the toss with me about the law, 1% want a fight and the other 2% genuinely are unaware. This month I have 10 parking fines to collect from a couple of traveller sites, and 1 from a former member of the SAS who, I happen to know of from other business matters. They have all ignored my notices, it should be interesting.
I generally don't have a problem with them, to be fair. The only problem is actually finding the right one, its odd how many answer to the name of Smith. Its fine if the car or truck is there, but as long as they don't lose face, it either goes one of two ways. I get paid or I don't.
Thankfully in France private parking fines don't exist.. unless you're talking airports.. there is no such thing as these dodgy schemes where you can get away with tiny notices and non-existant paper fines supposedly put on windscreens.. they did away with the paper versions a few years ago that the police were using as they often got destroyed in rain or scrumpled up by mischevious souls..
I don't know if it still holds true, but it used to be the case that foreign plates were too much hassle to check, so the system in effect ignored them. Which surprised me to see that travellers didn't tend to have them, much beyond Irish plates at any rate.
I know of a guy that had travellers on his land, so turned up with a digger. He told them he was digging a trench all the way round the site, and it was their choice which side they chose to be on, and then started digging. They left that day.
In my letter it states i had 21 days to apply from the date I received the ticket - but i never got a ticket, so surely the 21 day limit is void and can still appeal? I visited a shop in the site so will probably appeal to state that i made a purchase, however, it was a cash purchase, and will get the shop to provide CCTV if required
I would have had them off in 12 hours, two visits, one notice for each carvan and 12 hours later one **** off tow truck. £950.00 plus vat plus expenses. All legal and above board, no need for the Police.
I know businesses who have to live with their customers getting fined, it seriously pisses them off for the reason you give, but they are powerless, it is their landlord who has sold the rights on; its all about money, getting every last penny out of their asset and they don't give a **** about the golf shop, you or your balls. The half of the car park that Staples and the supplements place is in is owned by Staples not a third party. The other half of the car park closer to the main road is owned by someone else completely. I know this because I asked our surveyor at work to look on the land registry. If your partner parked in the Staples/Monster half a nice email to Staples head office with the date and time you made your purchase should get the charge quashed.
Dunno , might have. When I got my ticket think it was still open. They deff owned the car park then. Still worth an email though.
I went last Sunday and it was shut, I googled the opening hours before I went, so I was a bit pissed off. I was going to call them on Monday to complain, but when I googled Staples Hull, the first thing that came up was a HDM article about it closing down.
I think it has moved to a different location in Hull. That car park used to be 90 minutes free parking for people using the shops. I always used to use it for Staples or American Golf then wander into town. I have done that at least twice in the last 6 weeks!
