    And yet this is not the first time where De Pfeffel left the borders open in spite of overwhelming evidence that they needed to be closed, and as a result the virus exploded in this country. Last year it was when Covid was causing chaos in Italy and Spain yet he was saying he'd be a hero of capitalism

    The only difference this time is how, last year, the belief was that Cummings and Cummings alone was behind the push for herd immunity in spite being ignorant of how to achieve herd immunity (I.e you needat least 80% vaccinated) - but with Cummings out the door last December all the ****ups, such as leaving India on the amber list to try and get a trade deal (and get quarter of a million quid into Sunak's wife's bank account) or somebody with the Brazilian/Eye of Horus variant could wander home to Croydon without quarantine can't be pinned on Cummings, which begs the obvious question: how much was Cummings preaching to the choir eighteen months ago?

    How do those terms of service remotely work? I can't see how they'd stand up to any scrutiny at all.

    The sad fact is they would, because unless it's a federal case it has to be heard in the state where the company or corporation are headquartered

    That's where SLAPP suits often fail as the SLAPPer has to prove the SLAPPee does business in their state so they can have it heard in a local courthouse (which is basically a move to play to the gallery by hoping for a sympathetic, local ear) and, when they can't, the thing falls apart

    Wouldn't state targeted ads **** them, in that case? They're clearly doing business there.

    Likely falls under the same thing, because if the ads are targeted from Facebook HQ that means they're not doing business outside of California, they're still doing business in California in spite it affecting Ohio or wherever

    This is something Digital Homicide tried in their failed SLAPP suit against Jim Sterling where they tried to prove Sterling had business in Arizona (where DigiHom, aka two brothers knocking out a ludicrous amount of ****ty games from their bedroom, were based) by donating $1 to Stirling's Patreon every month as well as buying a t-shirt from Sterling's website. Suffice to say that not only was this completely inadmissible due to neither Patreon nor the online store being based in Arizona, but technically what they did was donate something like $25 to Sterling's defence fund

    In comparison, the SLAPP suit that Bob Murray took out against Last Week Tonight a few years ago was tried as a federal case, which is why Murray was able to get the case heard in West Virginia (which is one of a handful of states which hasn't passed anti-SLAPP legislation) in spite of HBO and Time Warner both being based out of New York - although that also ended up falling apart, not least because the five justices who were hearing the case were all impeached simultaneously
