Let's remember we are not actually bothered about the value of the loss. Just that the loss has happened because of the event. I.E The PL wrongdoing!
This is when **** gets real. Are we talking about losses and the actual claim? Our biggest worry. Or is it to get the deal done. If the latter the loss is irrelevant.
Its a tactic - pass it or we're going to try and claim value of the club it sells for now - the £50k NUST has rustled together and the £340m + £12m in damages - I think. I'm taking the piss about the £50k before the snowflakes start
And to back what i have just said up. If the Judge thinks that the CAT claim is not relevant (I.E ARB should take precedence) then why would he challenge the compensation claim anyways. This leads me to think that he believes a case is there to be answered and again the compensation balance is again irrelevant because that means wrongdoing could have happened.
He's gone off point. He needs to bring it back in. He is quoting case law so hear him out. It's reverent but only if the circumstances are the same.
