It is essentially the PL trying to keep everything in house and confidential. That raises the question of why if they have nothing to hide. Pincer movement from Ashley that is working.
Happy days. And that my friend is called “having them by the short and curlys.” In other words the CAT has always been the threat of exposure. And the PL don’t want that!
Yes it's crystal clear they're hoping to hide their dirty work. This is potentially the end if its not thrown out. Seems last ditch to me
In the US these lawyers would be standing outside in front of the journos giving overviews of why they’d win, what their line of argument would be, how bad the other side are - I’ve never liked that..... but today I think the legal systems in the UK are so up their own arses and self-perpetuating and secretive that - just for 24 hours - I’d like to swap. The ducking silence from key players is doing my mental health in
Ashley has got a victory here. Expedited arbitration. Prevented the release of commercially sensitive information to the PL and forced the PL to act to prevent this going public. If the PL's jurisdiction claim is lost expect something to happen. They are trying desperately to avoid evidence being heard that will be made public.
I’m not sure mate. I can’t see it being thrown out. The Arb case ruling has to be published and the reasoning behind the decision disclosed. BUT.... not the evidence behind the reasoning. The CAT case will be full disclosure no holds barred. If you MA or NUFC and you are doing this to achieve an outcome your basically playing your cards in a certain order. You then say your move. I think this is where we are now. MA has nothing to lose here so he can push and gamble to his hearts content. The PL have everything to lose. Literally any revelations revealed into their conduct opens Pandora’s box and is surely to big a risk to take even if they win!!!!!
1. No cat case the premier league can hide their foul play... They'll go to arbitration and take their chances 2. CAT case not thrown out the premier league will likely fold. Simples
Both instances it suggests that the PL case is weak, that they know it is and are trying to stop everything becoming public.
They are trying to under Rule 34 - a concurrent tribunal hearing dealing with the disputed issues. I suspect it won't be. The issues go beyond those in contention In arbitration.
But they are two completely separate cases with totally different technical arguments? One influences the other granted but they are very clearly different. So am I right in my understanding that the PL have indeed been granted a 28 day extension to effectively supply a case for the CAT to not actually happen. This ties in with my earlier point that the CAT is fundamentally linked to the outcome of the ARB.
They're desperate to hide things, so it all rests on whether they can or not whether they take their chances I guess.
