I'm beginning to believe getting the CAT case thrown out is there lady hope actually. They're desperate to ensure their dirty dealings aren't out in the public. I have concluded that if that fail and its not thrown out they'll all of a sudden fold
You are on board. They are trying to get the CAT case thrown out because of what will come out. Applying delays as they did with PIF.
The PL failed in their bid to have confidential information released to them to aid their response. NUFC attached a confidential addendum containing commercially sensitive information. They are challenging on jurisdiction grounds - a technicality. They have applied to have the claim struck out under Rule 34 tribunal rules. Essentially to have the case struck out without the hearing of evidence. So the PL are trying to prevent the release of evidence which would remain confidential under their own arbitration process. Now do we see why the CAT case has been filed? Ashley is doing it to make public their dodgy dealings. Arbitration won't do that.
What they are trying to do is have CAT throw out the competition case because it is going through PL arbitration. They are using Rule 34 Tribunal Procedure Rules to argue a technicality. They are not challenging NUFC's claim, merely trying to keep it in house so that evidence remains confidential. They are applying delay tactics yet again. If I am right, then that tells you that NUFC must have fairly damning evidence that the PL do not want made public.
And this my friend IS the reason why the PL simply have to follow through with things. Sometimes it’s inevitable your going to lose. But at what cost. The PL have to do this because they have created the issue in the first place. To fold Now would set the new standard and their control over everything dissipates. They very well may know they can’t win, push through lose and then say to one and all. Ok we lost on a technicality but we will now shut the loophole down.
I won’t pretend to understand wtf you just said but it’s sounds epic. So basically this is the big boys playing chess!
