It is outside the scope of the O & D test unless the clubs are classed as the 'executive.' If outside the scope of the test, the decision would, if the PL were a public body, ultra vires and subject to Wednesbury Unreasonableness. They aren't though.

We have big problems if we’ve voted it down, as we have commercial agreements with Saudi all the time, I doubt we’d shoot ourselves in the foot given how Woodward and The Glazers don’t care about football.
This season our first 10 games involved 7 of these guys: The year before our first 8 games involved 6 of them. It just gets a bit tiring/predictable. It really doesn't feel random to start the season with a batch of games we're the underdogs in and then have to fight up to midtable.
