I mean, probably? They already exploited another loophole that allowed them to completely write off any punishment for the breach during the 22/23 season. The issue for me is that they are already relegated anyway, so a points deduction now just makes them finish last (though it would give them Derby’s record) which would also cost them £5m in prize money due to dropping two places, which given their owner and incoming parachute payments (plus money from inevitable sales), will be eaten up without issue. It’s not a deterrent if it’s applied retroactively and the outcome is the same. It should be 15 point deduction applied this season, with a transfer embargo for two windows. Seems harsh, but if the point of this whole FFP thing is to encourage less reckless spending, then the sanction should reflect that goal.
Yeah but the thing they did wrong they did while they were in the EFL. If it’s the case that the punishment can only be meted out in the season that the verdict is reached, then they’ll just delay if they knew they would go up.
I understand, I'm just going off what Kieran Maguire has said, which is that any points penalty would only apply upon re-entry into the PL. Financial penalties will apply next season regardless.
