It's also the type of drug. It's not as serious as some others, it's not illegal, wasn't taking cocaine like kezmen.
I doubt you will sack him, as you paid £18m for him. However, I'm certain that he'll be in breach of his contract and therefore could be sacked - if you chose to.
Depends on the details but from a bit of research I've done these pills are commonly advertised in shop window displays and mainly seem to be mega-doses of caffeine/green tea etc. so taking a "fat burning pill" shouldn't make you feel the equivalent of a "drug cheat"
Yes, and I would even consider a legal drug like cigarettes to be more important for banning Imagine how fat Rooney would be without his nicotine
He's a professional athlete and therefore knows he's subject to drugs testing. Therefore he will know not to take any medication without checking if it's on the banned list. Beyond this, he shouldn't be self medicating anyway, without the advice of your own club Dr. You're also assuming that you know why he was taking them - you don't, so on that level you've also assumed innocence.
It depends if could sue him like Chelsea did with kezmen flr £12m was it? I Don't know how wages work, do we pay him full/reduced wage? If it's 2 years it might be cheaper to sack him then keep him and pay him wages for those two years then try sell him for pennies afterwards. I don't think we'll sack him. Best case is 6 month with regular testing afterwards
If he's found guilty he'll be in breach of contract and therefore entitled to nothing. You could sue with as Chelsea did with Mutu (not Kezman) - for the transfer fee. But the likelihood of ever being paid it are slim to **** all. I suspect you'll reach an agreement with him, that he'll get jack **** in wages during his ban, but you won't terminate his contract and sue him.
Yes but that zero tolerance needs to be applied to Toure. Depends what the fat burning pill looks like. Is it something you can just buy from Holland and Barratts. Its unlikely he's gone to some super shifty secret dealer (kolo? ). I'm not saying he should be punished but you are looking at his misdemeanour as a very black and white thing. He took the pills, he deliberately cheated to gain an advantage etc. Also doubt liverpool will sack him, that's an 18 million quid write off right away if they do
Mutu yes, my bad. Yeah but if we keep him, would we just pay him nothing for a year while still employing him? Not sure you can do that. Suspended without pay for X years? In in any other walk of life person could resign if they've been suspended from work and try find a job elsewhere, by footballers can't really resign so not sure how that works.
Hence the reason I said - if you reached agreement with him The prospect of being sued for £18m might make the idea of 6-12 months without pay a more attractive proposition.
I didn't buy toure honestly I don't know what sahko took but it was on a banned list end of.... none of this stuff i'm seeing here is anything to do with any info thats available. you fail a drugs test its serious. All i see are excuses.
Mutu got sacked for cocaine. Merson did not, nor bosnich.. and fredinand didn't do a test but got 8months... cheslea decided to do for him and then pursued him after he joined a different team after his ban... they were quite draconian honestly. I believe in zero tolerance of this stuff. You cannot have the best medical staff possible then have a guy flout it. he's done damage to the team and club so he should get whats coming.
Its a contract. If you have a contract and walk out of it anywhere you can be sued. any job. there can be no work clauses for the period if you walk out for example. Its the transfer fee that cheslea got.
It is a very 'black and white' thing. He took the pills, (he's apparently admitted it) they contain a banned substance / substances - therefore he's guilty - the end. His motives (whatever they were) are neither here nor there, he KNEW that he's subject to testing and therefore shouldn't ingest anything that wasn't signed off as being OK by the clubs medical team, but he chose to ignore that and take whatever he took, for whatever purpose.
Well he will probably go one way or the other.. We can't wait around for him to play so will buy a replacement...if that replacement is good enough then we will sell him anyway. Unless he can forge a note on a brown paper bag signed by Rodgers saying "big arse reduction plan"
I don't know if employment law allows you to actually employ someone, not allow them to resign/terminate contract and not pay them.
