Swansea got thro by beating chelsea over 180 minutes , are you saying we only won because of one 6 second incident , grow up and smell the coffee.swansea were not time wasting , have a look at game again and look at the quick free kicks , throw ins etc we were taking

People see what they want to see, indeed. I'm sure if the situation was reversed, and one of our ball boys had done this at Stamford Bridge, the same numpties would be on here whinging what a classless lot we all are etc etc, and how the poor old player was just making a genuine, if robust, effort to get the ball back into play.

Spot on and something I also said on Twitter. Imagine if a Chelsea ballboy had time-wasted in that manner whilst 2-0 up this denying Swansea the chance to get back int he game.

We aren't the saying that, there isn't one Chelsea fan on here that denies Swansea deserve to go through and the red card made no difference to the game, we were never going to score with a performance like that.

The issue is, why our 22 year old player has been victimised by the press. As a Swansea fan you must know all to well what that is like i.e Ashley Williams.

Its a real shame that this is taking the gloss of a well deserved victory, swansea are well known for keeping the game flowing quick free kicks throw ins etc

In all honesty, whether the boy "deserved" it or not is irrelevant. It's common assault. Something which has been illegal in this country for time immemorial. The punishments for it have been enshrined in a Parliamentary Act since 1861.

It's an open and shut case of battery, which is a lesser offence than Assault Occasioning Actual Bodily Harm under s.47 of the OAPA 1861 as, obviously, there was no
harm beyond that which is "wholly insignificant" (r v Chan Fook).

Actus Reus- Infliction of unlawful violence
Mens Rea- Intention or Cunningham recklessness

Open and shut, maximum of 6 month sentence handed by the magistrates, but unlikely to be anything other than an absolute discharge following a successful prosecution for battery.

Sorry for the mini-law essay, but most people here seem to have forgotten how we do things in this country and seemed to need a very basic education on our law.

It's also amazing how some people never miss the opportunity to tell a load of strangers how clever they are just because they've done a bit of study. This is a football forum FFS not the Rumpole of the Bailey Fantasy Barrister Role Play website <ok>

It's hardly showing off. It's basic stuff that you'd learn in the first year of A levels. It's just clearing it up after watching people trying to apply a pub understanding of the law.

It's not assault. There was no assault there. The ball boy is the sort of person who would run into your car and then claim damages. Pathetic.

Of course it's showing off. This is a football forum - why did you feel the need to "clear up"? In all 71 posts there isn't one where someone's said "I think you'll find this is defintiely the legal position"...... And as for DL's comment - your response to which I took exception hence my posting, I think you'll find he was taking the piss.

Perhaps, but then whose decision was it to bring this 17 year old 'boy' out of 'retirement' to be a ballboy for the first time this season?

He then tweats about his time wasting intentions on the morning of the game...oh and he happens to be the son of a director at Swansea.

Doesn't leave a nice taste, much like Stoke taking 3 weeks to take a throw in at the Britannia.

A few players said last night that it's standard practice for the home team's ball boys to speed it up when it's their team and slow it down when it's the way team. At Watford we used to give pur players a towel in the rain and not let the other side use it (we used to think it was hilarios but had the shoe been on the other foot we'd have been sreaming blue murder!). I guess it's all about degrees and last night that lad took it to ridculous extremes.

Yes, that's right we've beaten teams comprehensively at the Liberty because of time wasting. <doh> What a muppet.
