You can have sex at 17, but not with someone Andrew's age, which would have been what at the time, 40?
 
The age of consent for a 17 year old, only means with a partner no more than the age of 23 or 25, I can't quite remember which.

She was underage, in that, Andrew was too old for her.

@Treble look at it another way, its intention of the law (I assume) is probably to avoid a young woman from being groomed.

I did read her case clearly defined somewhere in regards to age, but I can't remember where it was now.

Can someone tell me a state that Andrew is alleged to have had sex with that girl?
 
If it was Florida, then this is the law....

The Florida Age of Consent is 18 years old. In the United States, the age of consent is the minimum age at which an individual is considered legally old enough to consent to participation in sexual activity. Individuals aged 17 or younger in Florida are not legally able to consent to sexual activity, and such activity may result in prosecution for statutory rape.

Florida statutory rape law is violated when a person has consensual sexual intercourse with an individual under Age 18. Close in age exemptions exist, allowing minors aged 16 or 17 to engage in sexual intercourse with a partner no older than age 23.
