Got a dashcam after an old lady ran a red light and T-Boned me. 20 seconds ealier and she would have taken out a guy & his girl on a goldie, potential fatality. She drove away but returned. Meanwhile a witness had stopped and gave me full contact details. Anyway, old dear comes back full of apologies and admitted fault. Exchanged insurance and contact details as no one injured and off she went. That night I get a call from the coppers saying I have been accused of running a red light! Bloody incredulous. Anyway, witness corroberates my statement and my legal says its an open and shut case...but it went to court where my barrister gently tore the lady to shreds. Total cost of court and fees was just under £25,000. The place took no action against other driver who had lied to them and was clearly unfit to drive. Why then does she get away scott free and continues to be a danger to other drivers while I get speed trapped on Dame Dorothy Street at 33mph and get a ticket "in the interests of road safety". If I hadn't had a witness it would be me, angry man against a little old lady who looked like everyone's gran and I know how that would have turned out. The new Nextbase dashcams are excellent and have shock sensors with virtually 360 degree vision, useful for the trolley twats and door bashers, a bit pricey though
Maybe 20 seconds earlier they'd have just been driving through a green light? I never knew insurance disputes could end up in court, I thought if it got too complicated the insurers just go 50/50 and **** the case off.
After you car was fixed your in surance company claimed you were a risky driver even though it's not your fault No fault claim bang up your premium.
Not the case mate they tried to go 50/50 for my daughters knock. It wasn't her fault and I caught her case the other party paid out. But because of no fault no claim ( the other party paid ) She was penalised on her renewal.
Do you know that was the reason for certain? I've been involved in not-at-fault accidents and my premium dropped the following year. Insurance companies are hemorrhaging funds because of fraudulent claims, they've gone a long way to stopping that now, you can't claim whiplash if somebody hits you and they were doing less than 15mph nowadays. But in the past they had to pay out every time, regardless of speed, that was pushing premiums up in areas that were prone to claims, I lived in one for years and my premium went up every year regardless of what I did, then I moved to where I live now and it dropped by hundreds of pounds.
Yeah I was told that even though she never made a claim because it was called a non-fault claim her premium had to go up this was two years ago I don't know what the rules have changed I have never made a claim since
Nah, White Mare Pool, coming off the A194M, lights are on a fair wack while those controlling roundabout traffic just for 10 seconds or so. My barrister said he was surprised too, don't know why as it will have cost the other drivers insurance the £25k. First time I've seen barristers in action in the flesh, it was quite entertaining. Other drivers bar said to me "should you not of observed the other driver as she crossed the white line" No, I replied but I did observe her when she hit me (faint smile on judges lips). My bar cross examined the other driver. Started with "Mrs M, can I get you a seat to save you standing" Yes she replied, that would be nice. She sits down "are you comfortably now" Then proceed to tear her story to shreds. Before all of this I would have been happy with my car fixed, and my excess repaid, about £2.5k. Instead of this the cost was tenfold and we all have to foot the bill for crap like this through inflated insurance premiums. On a positive note it had no effect at all on my insurnce premium once the case was settled. Until then of course I WAS classed as having had an accident.
I've had a barrister cross examine my evidence before, they try to pull you apart on your training, it's a proven method... eventually they'll find a discrepancy and your evidence will be worthless. I trained under classified methods and just told him I didn't have to answer any of his questions and he nearly cried. They're just pussies in dressing gowns if they can't get their own way.
