In America, the widow of a chain smoker is awarded 23.6 Billion Dollars compensation. The case dates back to the 90's but even then people knew the dangers of smoking.
Balkan the case is only from 4 years ago. The 1st cases being convened in USA courts started in the 90's. The claim for the Widow is because her husband was'nt told about the effects of smoking. The compo will be reduced. But i hope not.
I think compo claims are ridiculous. Although i'm a strong advocator of people's free choice, NO ONE can deny they don't know the risks. Jeez i'm old and even i was taught about the risks at school and even if i wasn't it was common knowledge. Where did this guy live out in the Mojave Desert! I think her indoors will be encouraging me to smoke more now, she thinks she is sitting on a potential gold mine. Seriously though if i drink, smoke, take drugs and die from it, that is my choice I certainly don't expect someone to gain compo from it. Guess that's just blown the other half's chances, when future lawyers look at this post.
In the USA for lifetimes of generations and here in blighty you are seen and yes you are seen BrB as a social pariah if you smoke. Freedom of speech & information are for the masses but only seen so far as in recent years not for a cigarette maker to whisper lovingly into the ear of any Individual of the harm & risks of pulling on the dreaded weed Business is business. Profit is profit. Have you BrB lived a life of excess.? Do you smoke? How can we make life better for you without cigarettes and the answer will be Money. Yes the husband & wife will say. Lots of money will ease our suffering. So the cigarette company who has 100's of BILLlIONS of $ Will be Invariably made to pay by legislation. So the Government can claim an Ethical Vissicitude for the Dead ( yes a dead mans Lungs are a commodity of finance. I dont know why) and Taxation on the compensation is paid to the Government and the game starts again at the beginning.
In the USA at a guess from my experiences, you have only become a social pariah out there, over somewhere in the region of the last 15 years. All escalated by the deaths of various Marlboro men. Although i believe most legislation like the UK only came in within the last decade ie in restaurants. Although i cannot remember who led the way the UK or US...i guess maybe the US dependent on state you look at. However, some parts of the states ie Key West as example have areas where bar smoking is still allowed. Although how they are governed slightly different from Florida law (being in State) i've never reviewed, apart from knowing they are a pretentious Republic. Have i lived a life of excess, yes, i have. Do i smoke yes. Do i expect to live without the aid of my other half, I expect nothing from no one. That might seem hard to understand but that's who i am. As for lawyers, the only example i can give to validate my own voice, when involved or shall i say the victim of being stacked on the M25, compensation lawyers approached me. I told them to do one. I live by my words, i die by my words. Although maybe we could have a level playing field and ban every driver who is proven to cause ANY injury through accident. That will keep the lawyers busy and in the money. Now people can point me towards the NHS has example but is that really much different to your fat eater or careless driver, everyone is a strain at some point in their life, I'm just not selective on who shall be treated, I'll leave that to the taxpayer's to which i am one. Probably in 50 years time, when i'm well gone and buried, the devices of today may have been completely outlawed, then people can turn their disgust to something else to campaign against, until they have formed the perfect clone, that's if the human race don't self destruct it's own pretentious superiority in the meantime.
If that's the case, then its even worse. Rather than giving all that money to the relatives the court could have made the company pay for an education program so no one can say they didn't know the effects of smoking. Alternativley if the court wanted to kick the company in the nuts, the money could have gone into the health system which has to deal with the effects
If they get us all healthy and living longer, the pension pot will need topping up a bit. Smokers and boozers pay in plenty and tend to be less of a strain on pension funds.
I never checked it was accurate, but I've read several articles claiming the NHS cost of treating smokers and drinkers was far less than the in tax from them. Effectively, they propped up the NHS which was a benefit to others.
