    Seen a couple of people mention the takeover and Rafa:

    They are saying that if a takeover is happening new contracts cannot be given by either party - no idea if true or not and am sure someone knows something (well claim they know something or have had it told to them from a twatter source)

    Until the take-over actually goes through the employer is Mike Ashleys company and they can give new contracts if they want but... will not do so if they can avoid it as if it all falls through they have to honour the contracts and it reduces the flexibility of the new owners. The new owners can't give new contracts, they don't own anything to do with the club so there's no legal standing. The can agree in principle terms for contracts but they would all have to be conditional on an actual purchase of the club - managers/ players/ agents aren't going to want to rely on that.

    Nothing stopping NUFC from giving him a new contract. TUPE protects Rafa in the event of change of ownership. It's a case of fat Mike wants rid do he can get a cheaper manager who will finger his ring piece whilst sucking him off.

    This is true in business.
    Higher level employees on big money could impact the potential valuation.
    If the takeover drags on the sensible approach would be a 12 month extension to the current deal to give the Arabs time to sit down with Rafa on future planning.

    I too had heard that once negotiations had started the outgoing management cannot sign new contracts which tie the hands of the buyers and the buyers can't offer a new one to someone who is not 100% theirs. Seems perfectly reasonable to me and may explain the total lack of news from Rafa or NUFC

    The terms of the sale probably preclude it but legally whilst Ashley owns the club he can offer contracts, he just risks losing the sale and/or wasting money.

    It's similar to when you buy a house, there's usually a gap between exchange and completion. In that time the seller still owns the house but the buyer is obliged to buy it. If the seller puts in expensive new fixtures he wastes money and if it's not what the buyer wanted he can sue for damage or try and use it as a breach of contract to void the agreement. Seller can do it if he wants though.

    Long time since I've dealt with TUPE transfers but basically you've got to be an idiot to mess with or change employees terms and conditions without good reason during the sale.

    It’s likely a combination of the above and partly dependent upon whether any form of agreement has been signed and exchanged.

    If Agreement signed it probably requires Seller to obtain Buyers agreement before altering significantly the employment position of any current employee and/or granting or cancelling any new or existing contract.

    If no Agreement signed then Ashley isn’t going to do anything which incurs him expense such as buying players or reducing value of Club such as selling players. Also won’t touch any significant contracts that might impact on sale.
