I like the way the council suddenly think they are important in this deal, correct me if I am wrong but: The council own the stadium there is a set lease for the use of the stadium the SMC manages the lease the Allams own SMC So new buyers buy SMC as part of deal, they takeover the leasehold management (as you would if you bought a leasehold property such as a flat in a building). The SMC manages who uses the stadium and that fees are paid, therefore Hull City AFC can us the facilities. Council only really need to be involved if the new owners want to buy the stadium or redevelop, not likely to hold the deal up
The Chinese are buying the club from the Allams why would they need to talk to the council before they own the club and the SMC? For me, unless they have permission from the Allams to talk to the Council, the professional way is to begin discussions once they own the SMC. Although the Chinese may want to renegotiate the lease rather than buy the stadium or redevelop the area.
However there should be no reason a potential buyer could not sounding out the HCC as to their appetite on selling the stadium or not, as that might make the difference in whether a deal is put together or not.
Firstly, as part of the sale negotiations they may not have permission to approach the council. Second, don't you think any approach to the Council could affect the purchase price? Third, why would you want to buy the stadium? I'd be more inclined to hand it back and negotiate a more sensible lease which didn't make Hull City AFC responsible for all the repairs for the coming decades.

I guess it depends on the buyer, but I agree with your point would seem better to negotiate a better lease agreement. Though if the have designs on in time increasing the capacity and devoloping the stadium itself, maybe like the Allams, they feel spending money on something you don't own is not the right thing to do. The stadium is currently free, neither the club nor the SMC pay the council a penny, do you seriously think we could improve on those terms?
In all seriousness we do pay something for the stadium use don't we? Think it was described as peppercorn rent which is nominal? I'm sure we did when we first moved across?
I was thinking more along the lines of a longer lease. If I remember rightly SMC are suppose to pay HCC a percentage of profits, but it is always engineered that they never do make one?
