There is a difference between overspending with the agreement of the owner and overspending without the owner's agreement. As far as we know Brown overspent with the agreement of the owner. Mackay didn't have permission to spend what he did if Tan is to be believed. This may explain why Brown walked away with a settlement and MacKay paid his legal costs and issued an apology.
