If a player has a release clause in their contract then it's not possible to tap them up under the current regulations. A release clause, however worded, essentially gives a club the right to agree terms on a new contract with a player, with that player then having the right to break their contract by paying the appropriate release fee. That's essentially what we did with Herrera - sorting all the details out with him before actually agreeing a fee with Bilbao. Also, as Custard says, all clubs do it now. I think clubs recognise that attempting to prevent any tapping up is pointless as the fines levied are so small and all they end up doing is having a player agree a contract with one club, making it impossible to engineer a bidding war when the player eventually forces the move. Look at the Berbatov move - Spurs squealed blue murder all summer, refusing to talk to anyone about him, then when City came in with a massive bid they were forced to sell him to Utd for less as we were the only club he'd talked to and he'd already sorted out everything with us and wouldn't even talk to City. The net result was Spurs ended up losing a few million quid in fees, with no compensation, and Berbatov left anyway.
