    I personally have no doubt whatsoever that the rules are illegal and Man City will win. These big 6 arse lickers aren't talking about the legality are they? They're talking absolute bollocks about the competive nature of the league which is exactly the problem with the rules. Football was fine before them wasn't it.

    Woah, sorry - I meant in relation to this specific case as relates to sponsorship deals. If they wanted to inject wealth into the club, they should've been allowed to do it as it meant zero debt building which is what the whole PSR/FFP stuff was supposed to stop.

    In terms of tax dodging, false reporting, fake accounting, then they should be held accountable for that - the overseas payments and a lot of hidden payments (Haaland, £50m, really?) need to be brought to task but that's a complicated knot to unpick; some of the restrictions wil have led to back-alley dealings. They'll still be hit with a punishment for not complying with the competition rules but a number of them will be struck from the record as they could then relate to anti-competition laws which, as Hamish says, trumps the competitions rules. Laws > Rules.

    I’m still not overly convinced.

    Why would Everton and Forrest bend over and take them penalty points.

    The rules of the competition were set. The parameters of the competition also. FFP must be a legal. Surely.

    The other points are all legal like selling alcohol to kids taxes etc. Them rules still apply obviously.

    But the FFP stipulations are the rules on competitions.

    It’s a bit like athletics. You can’t take supplements of some sorts as they are banned for competition. But they are not illegal.

    I just never understand the media agenda. Holt's a paid journalist yet there's more intelligent and thought-out comments on this forum alone. It's like the election thread. The point is that the PL is restricting some clubs - particularly those wanting to challenge - from doing so through ever-increasingly spurious methods. City are effectively challenging the rights of anyone to dictate how they can generate income, because it makes no sense. If a UAE owned company wants to effectively show fealty to Mansour and the ruling family by paying £100m to be the official grass sponsor of the Etihad, who suffers? Literally the only thing at risk is success of non-Gulf owned clubs, and jealousy from other supporters. The club itself is not lumbered with any debt.

    City already have more money than anyone else in line with any PSR, so the interesting point of this challenge is that City are still able to spend more than anyone. This, to me, looks like a Gulf State vs PL challenge, led by City.

    It's not an FFP challenge, mate. It's challenging a club's right to gain sponsorship and why the PL can dictate how much that's worth. City will still be charged for their misdemeanours, this just takes a number of those charges away. 115 but there's a list, I'll try and find it, but only some are about breaching FFP, most are about accounting, overseas payments, hiding stuff, etc.

    Found:
    • 54x Failure to provide accurate financial information 2009-10 to 2017-18.

    • 14x Failure to provide accurate details for player and manager payments from 2009-10 to 2017-18.

    • 5x Failure to comply with Uefa's rules including Financial Fair Play (FFP) 2013-14 to 2017-18.

    • 7x Breaching Premier League's PSR rules 2015-16 to 2017-18.

    • 35x Failure to co-operate with Premier League investigations December 2018 - Feb 2023.

    If it’s mostly about accounting stuff etc then the accounts get audited. And if the auditors are not picking things up then yes throw the **** at them.

    Controlling sponsorship money is a new thing isn’t it? Only introduced when we rocked up with a big bank balance. So that can’t be part of the historic 115.

    I would be interested to see the charges. Just to see what they can legally challenge on.

    So the 115 charges and this legal challenge from City to the PL are completely seperate.

    Got it. So this legal challenge by Man City could be in fact correct. And the deals with connected parties being reviewed by the PL illegal. Fine.

    The 115 charges still remain.

    Absolutely right.....I'm listening to the responses from all these idiots and they very conveniently complete ignore the allegation that these rules are illegal.

    The talk of this challenge threatening the competitive nature of the league is actually vomit enducing! It's the polar opposite.

    I listened to one turnip use the fact 12 clubs are against the challenge.. 1..what about the other 8 clubs ? 2. Are Turkeys going to vote for Christmas?

    City have won the league 6 times in 7 years. The irony of claiming City are trying to have a monopoly in the face of what they've done is laughable.

    This challenge actually allows Villa and Newcastle to flex, and it makes Gulf (or other vastly wealthy areas, like India, China) investment more appealing as relates to clubs with a lot of room for growth like Leeds, Forest, Everton, etc.

    If this comes off, Kuwait could just pop up, buy Forest, add loads of sponsor money and get some big players, securing the club's infrastructure and future. The league needs change, it's suffocating itself.

    Ultimately it doesn't stop the 6 clubs that sell the notion they're special continuing to spend within their means.

    The big 6 are actually the most cowardice sporting foundations that exist anywhere in the universe. They're the equivalent of transvestites celebrating victory in women's sports.

    Sorry I thought you were referring to the 115 charges against them. The rules regarding sponsorship deals were brought in only after our takeover. Anything City did before that was not against the PL rules.

    The rules of the PL give every team in it an equal vote on rule changes so there cannot be a Cartel. The only pressure that the big teams can exert is by saying that, if the other teams don't agree to what they want they will go off and form their own league. It would actually be a breach of Competition Law for the PL to try and stop them doing that. The smaller teams tend to vote with the big teams as they realise their share of the pie is reliant on the big 6 being there.

    Competition Law definitely does not say that leading competitors are not allowed to communicate - they have the right to communicate, arrange joint ventures etc. What they cannot do is collude on price-fixing, or do other things, with the aim of excluding other players from the market.

    I think that the City legal action will be defeated comfortably.

    Man City aren't appealing a sporting punishment handed out to them that was broadly agreed upon.

    They are literally the aggressor here taking the PL to court for anti competitive behaviour and discrimination citing cartel behaviour. All very much illegal in the UK. To the point that individuals found guilty of Cartel behaviour can face prison terms of 5 years. They are taking out the first domino as you could put it (The related party transactions and fair market value) on 100% legal grounds which they can prove. Which as I've pointed out obliterates what football thinks it may be able to get away with.

    They don't need to gamble and fight the PL on the PSR being **** at this point because as far as the likes of their owners are concerned (and ours), they win this then PSR won't matter a jot if they can get a £1bn a year sponsorship deal from Etihad etc.

    What you'll find happens then, is the likes of Liverpool, Man Utd, Arsenal, Chelsea, Spurs etc all start beelin wanting shot of PSR completely so they can try and compete with ownership investment.

    We had the PL banged to rights on cartel behaviour. e-mails, and other communications from BeIN sports and the dirty 6 all colluding with one another to stop our takeover. The second the PL realised their dirty laundry was about to be put out for the world to see, the takeover was passed.

    The FMV and related party transaction rules are very much a form of price-fixing.

    Its underhand but its not Cartel behaviour IMO.

    Related-party transaction rules are not a form of price fixing. Price-fixing would be the 20 PL clubs getting together to agree standard ticket prices. The point of Competition Law is to make sure that consumers are not financially harmed by a reduction in true business competition. The PL clubs agreeing a rule that reviews related party transactions and sets them at true market value does not. In fact for accounting purposes most companies have to confirm that Related Party Transactions are at Fair Value.

    See, my view would be that that the top 6 colluded with each other by arranging an extraordinary general meeting (within 48 hours of takeover) to pass these rules through with the specific goal of stopping a competitor in their tracks. I would argue that they had to collude and lobby each other in private prior to the EGM with the specific idea in mind.

    I would then wager that they have no official log of these communications (legal requirement I'm led to believe) and I would then argue that they are price fixing in the very small and exclusive marketplace of corporate sponsorship.
