    There were some extremly racist comments made by that guy, they printed them on one of the online papers, his opening comment " lol " was the softest , he then racially abused fellow twaters who were sticking up for muamba, things went down hill from there.

    Bottom line is that the guy is a total prick and what he said was totally out of order, if people think they are allowed to post racial comments and incite civil unrest then they deserve all the punishment they get IMO.

    Does anybody know if JH has posted on the cardiff board lately ?? fits the profile me thinks ;)

    A guy from outside of Swansea but is a student in Swansea who keeps spouting bollox ...sorry Norway cant see the connection

    Leeeon: I know most of the local crim lawyers and can tell you categorically that even if he had been given wrong advice to plead guilty (which I seriously doubt), the Legal Advisor to the court or the District Judge in the absence of a lay bench would have refused the plea if the offence wasn't made out on the facts.

    If he was advised to plead guilty it's because he was. There must have been evidence of (1) an incitement to violence and (2) a racial element for the offence to be made out. If one of those was missing it's a non-starter and he wouldn't have been charged with it in the first place after pre-charge advice from CPS.

    Justice done? Probably. But it'll be a slap on the wrist if there's an absence of any previous convictions.

    Completely with Norway on this one...

    This nasty piece of work deserves punishment!! Quite disconcerting that vile individuals like him are wandering our city centres at night, whilst possible vulnerable decent law abiders are out peacefully enjoying themselves......

    When news broke about Fabrice collapsing it was trending on Twitter so people were searching for 'Muamba' to find out the latest news on the situation (I was doing it myself) so his comments were popping up with 1000's of people seeing them.

    Curious ... what exactly was the incitement to violence: (1) his original tweet; or (2) his subsequent tweets in response to those that were berating him ("abused" is his term as quoted in the linked article). What was the racial element: (1) that the subject of the original tweet was non-caucasian; or (2) that there were racial epithets in the subsequent tweets. From the little I have observed of this, it appears that any violence incited would have been directed against himself (as some of the comments in this thread illustrate) in retribution for the perceived offense of the original tweets. Can you be prosecuted for inciting violence against yourself.

    Just read the link from STID.

    There are sports radio talk show hosts over here that have commented that as a personal rule they don't tweet - they observe but never, ever post. As people who make a living by being out-spoken, provocative and often times deliberately take the extreme angles on things in real-time, they see Twitter as a channel that can get them fired but offers little to no financial benefit. Clearly it's a channel to avoid at all costs when you're not thinking straight, whether there are legal / criminal implications or not.

    YJ: I misread the report. Apologies. The incitement wasn't for violence it was for racial hatred. His comments qualify. This post, however, does incite violence and the OP has broken the law by posting it.

    KJ: Considering you seem to have inside knowledge about the legal system, maybe you could explain to me which tweets are inciting violence? Maybe I don't understand the term 'inciting violence'?

    I was reading the tweets as they happened, and there is nothing that could be shown in court that hasn't been captured as a 'screenshot' and posted on hundreds of forums.

    If the charge truly is 'inciting violence' as the newspapers are reporting, I think this will set a precedent. Unless someone can show me the tweet that incites violence. As Yankee Jack says, the closest thing to an 'incitement to violence' in these tweets were the tweets at him. Bit of reverse incitement anyone?

    I did read your original post Knackered, and I'm not sure I like what's happening here, worst things were said regarding Gary Speed, by some on the General chat forum of not606 at the time, but did they get arrested? I'm at a loss as to what's developing here, the guy said some pretty horrid things, but arresting him? something don't seem right here, and the author of this thread is insighting violence, should he be arrested?............. <ok>

    I am not backing this person at all, but I am really puzzled as to why this kid has been arrested, yes his comments are offensive and should be shot down in flames, but to be arrested for making a comments on a virtual place online is not for me arrestible.

    Free speech is something that should be cherished, going down the line where the state intervenes is a long the lines of China censorship or Egypt or Libya trying to stop the Internet, this person is an idiot any right thinking person can see that, they don't need a magistrate to tell them that, they are basically giving a troll an audience now, it's a pathetic misuse of resources in my opinion.
