    A habitual use does not make something a public right of way.
    A right of way is mapped (except for 12 boroughs in London apparently). The route in question isn't mapped. Some land owners have traditionally allowed people to use their land as a right of way but have to close it once a year for it to remain under their control.
    Which raises the question of why Allam is allowed to do this as the land in question isn't owned by the SMC, is it?

    I dunno if this is true but...

    New fence all the way round the stadium gates on the car park entrances.

    Is it true? If so then they have secured the full stadium.

    A senior councillor says the city council should rip up its KCOM Stadium lease deal with the Allam family.

    Ex-council leader Colin Inglis spoke out after the Allam-owned SuperStadium Management Company (SMC) closed a popular pedestrian route near the venue.

    The path from Argyle Street to the rear of the east stand was created as part of the council's original stadium development.

    It is also used by pedestrians as a route to West Park and Walton Street.

    However, it will be closed when Hull Fair opens later this week after the SMC said a security gate it installed without planning permission earlier this year will only be opened in future on match days.

    The SMC, which operates the council-owned stadium under a long-term lease, says the move is in response to an increased terrorist threat.

    Councillor Inglis said: "This is completely unacceptable behaviour from the SMC, they have been told repeatedly that the council will not accept this.

    "The walkway was built to connect a public highway, via a public park to another public highway, it is a valuable public asset. It was intended to be a public right of way, the terrorism argument is entirely spurious.

    "We will remove the gate, one way or another and the time has probably come to end the SMC's contract to run the stadium itself, given the appalling behaviour we have witnessed in this and other cases related to it.

    "I have urged the Council to physically remove the gate and consider very seriously whether these actions provide sufficient cause to end the SMC's management of the stadium."

    Earlier this week, the SMC said it did not consider the route was a public right of way.
    In a statement, it said: "The gate forms part of wide range of measures taken by SMC to improve security at the KCOM Stadium.

    "During a recent security review meeting with SMC, the North East Counter Terrorism Unit once again expressed concern to SMC that the unrestricted access to the KCOM Stadium provided by the Argyle Street/Londesborough Street pedestrian route rendered the KCOM Stadium vulnerable to third parties carrying out illicit activities."

    In a letter to the council, the SMC's solicitors Rollits said the company would not be submitting an application for planning approval for the gate because it considered obtaining permission was not required.

    It adds: "In the event that enforcement is taken by Hull City Council against SMC regarding the gate, such will be vehemently defended."

    I reckon the Allams would be overjoyed to walk away from the SMC lease. Finding someone else to take it on might be a challenge though.
