One guy on RH tonight said he thought the submission to CAS was not trying to repeal the FA decision, but the actual regulation the FA have which allows them to refuse a name change. Under EU law they claim that this is prohibitive in allowing a team change it's name, which affects their ability to make more revenue.
no actual mandate for how it is dealt with makes it an automatic win .. rthen it goes to another vote and it was too close to call in the vote originally .. I think it is 50/50 tbh
If the decision was refused once, why should they suddenly change their mind? It's common sense which our owner is sadly missing in this respect.
If he thought that I would have thought he'd have gone to the British or European courts for restraint of trade. He always has the option of withdrawing from the FA then he could do what he wanted with the name.
Because he'll have new 'unfair reasons' as to why they'd never have succeeded in the first place and will try to make the FA seem as though the ruling needs to be changed yadayadayada
If there is no process in the rules the CAS would look at the FA's procedure to determine whether it was fair and that the decision of the FA Council was rational, based on the evidence provided. Under the Premier League rules the club should have consulted the fans on a major change therefore the FA was in order in receiving submissions from the OSC, CTWD and any other fan groups. The club had plenty of opportunity to put their case and failed to convince the FA. I think he'll lose. The only way the FA could change its mind is if he puts in another application for the name to be changed next season. There is no provision in the FA's rules for them to change their mind. In the press conference I think he said he wouldn't put in another application.

The FA has said there would be no appeal, on that basis if Allam does go ahead is there any possibility that the FA will take sanctions against the club ?
So has there actually been an appeal, I know AA said there has but according to david conn the FA and CAS know nothing about it
The problem there is you would have to prove that it would generate more revenue which he could not do, however you dress it up the comments today about the council once again highlighted the true reason for wanting the name change
The FA find themselves in a world of diminished influence and, all to often, ridicule. They cannot afford to have their much studied and considered decision overturned. If it should happen (not totally impossible, but in my view unlikely) then stand back because the blue-touch-paper will have been lit. Revolutions have been ignited by less.
It's not even clear if the FA will agree to go to CAS, it's an arbitration service and both parties have to agree to attend. There's also a FIFA rule that says no club can take their governing body to court, though I'm not sure if they consider an appeal to CAS as court action. To overturn the FA decision, the Allam's will have to prove to CAS that the FA did not follow their own procedures, knowing first hand how conscientious the FA were with the consultation process, I don't think there's any chance of success. To be fair, I doubt Allam thinks he's any chance of success either, he just refuses to drop it regardless.
Dunno if its already been posted but this latest statement is off HDM. The Mail was contacted by Hull City late on Thursday night to explain references made by Dr Allam to an appeal being made to the Court of Arbitration in sport were actually incorrect.
