If you punished someone for attempted murder in the same way as you punished someone for actual murder, where is the disincentive to not just commit a murder instead of battering somone?

might be serious assault. depends how many times you hit him and what state they were in after it

if you repeatedly struck someone over the head with a hammer until they were KO'd then yes that would be attempted murder.

I would imagine that if you have just hit him numerous times to the head with a hammer, then the guy will be dead.

By hitting someone with a hammer to the head, I would say even one strike should be classed as attempted murder.

A guy that took my football team when I was a kid got 6 months for hitting someone with a slater's hammer.

Enough brain damage was done to victim so the dude spoke slowly and dribbled all the time. He was called Droopy in the local pubs.

Better to be safe than sorry though, no point in leaving a pesky witness lying around and if you do get caught, well what the hey, your getting life anyway whether or not you give him a final dint to the heid.
