So what would be the incentive not to just kill him?

I would imagine that if you have just hit him numerous times to the head with a hammer, then the guy will be dead.

By hitting someone with a hammer to the head, I would say even one strike should be classed as attempted murder.

A guy that took my football team when I was a kid got 6 months for hitting someone with a slater's hammer.
