Generally you appeal to appeal the ban, appealing for the sake of postponing the ban would be frivolous.

It won't be deemed frivolous. It's not frivolous when the player and team it was committed against are backing the appeal and also when it was the sort of legs flailing lash out that it was, and not a punch to the face or a throat choke or something.
