Who says she was passed out?

You are the halfwit for using rohypnol to back up your argument. Giving a girl rohypnol is completely different, as your drugging her without her knowing. That's completely different to a girl drinking alot of alcohol on her own accord.

If a girl drinks a bottle of vodka, and then throws herself at men, and one of the men take her up on the offer, then that's entirely her problem:biggrin:

Did I say it wasn't her problem? If she was sober enough to get into the car with the first guy, then she was ok. It's the rest of it that's ****ed <doh>

The rohypnol example was to show you that you're 'if she wasn't saying no' argument is bullcrap <ok>

If you were right then rohypnol rapes would be fine. The reason the first guy didn't get convicted was because she agreed to go back with him, the other chav just decided to jump in when she was unconscious.

I assumed it from the fact she had absolutely no recollection of any events there, there's being drunk and passed out, and she sounded like the latter. There's nothing wrong with sleeping with a drunk girl, but bringing someone you've never met back to a hotel because she's pissed is ****ed, and letting your mate in on the action is even worse.
 
I thought the point of the court of law was to prove beyond reasonable doubt that a crime has taken place. So how drunk do you have to be that there is reason to believe that you wouldn't have consented to sex had you drank a unit of alcohol less? More importantly, how does one determine this state of drunkeness?

Do you not think if she'd been passed out then she'd have said she was? It would strengthen the prosecution's case. I've forgotten things I've done, but when I've asked people about the lost time, I've not been unconscious. Just bladdered.

OK, let's assume she lied about everything even though all she said was 'I can't remember'? It's not like that's exactly a venomous lie. She said she had a few shots, less than she normally drinks then blacked out.

There's no reason not to believe her, especially when she hasn't accused anyone

I've known many girls who tell me they're bladdered and say they didn't drink much. They'll tell me what they had and they missed loads out. I'm sorry, but taking evidence from a drunk is no adequate. If she was date raped she would not be able to walk full stop.
