Lots of previous situations for this which back up her appeal, I've not read her story yet (will do later when i've not got a 2-yr-old on my lap) but the main one was Ahluwalia (sic) from the early 90's. Abusive husband for many years and eventually he came home one night, had tea and went to bed. She poured flammable liquid over him and set him on fire then went outside and watched the house burn down with all her and the kids possessions packed in advance.

Jury held murder but was reduced to manslaughter for diminshed responsibility and loss of control (either is enough, she got both) and she was released after about 4 years i think? It's been a while since i read the case but there's been lots like it since - Thornton mid 90's too.

 

As for my opinion. I know of about 10 cases where a woman has successfully claimed battered wives syndrome to reduce her sentence and every single one of them my view is that they should have been able to argue self defence (a complete defence meaning not guilty of anything at all) as the bloke 100% got what was coming to them - usually after many many years of dishing it out to their wife and children. I'd argue this is likely to be justice working well to be honest but will read the story later and get back

Sounds like justice to me too. Even the sons are speaking out about him.

 

He recently got two years in prison for the GBH offence to run concurrently with 12 months in jail for the each of the knife and affray offences, suspended for two years. He was also given a nine-month curfew and ordered to carry out 150 hours of unpaid work.

The lenient sentence is now pending going to the Court of Appeal...
