You are well within your rights if the original bet terms stipulate "... winner to choose ... " and there is no clause that says that this can be contracted out to a third party without your expressed agreement in advance...
You'd think Ponky would be more careful with these things ... but I think they still seal deals by spitting in their hands and shaking in jam and pickle circles ...
I've also consulted a medium who has confirmed that HIAG agrees with the above ... (and he's a Lawyer dontcha know)

Unfortunately Flos, you would have had to insert a clause that specifically states 'no consultation with any third party' into your bet parameters at the time you made the bet.
'Winner to choose' gives the winner scope to consult with whomever they like. The winner can choose whichever avatar they decide upon.

I beg to differ Ponky ... the wager was made in good faith between 2 individuals - therefore, under English Law, you can't outsource elements of it without prior agreement... but you are, of course, entitled to take your case to the small claims and lost unassailable leads court should it go tits up for you yet again ...
