You made the assumption of her being too drunk to consent (which is a bullshit reason to get 5 years in jail IMO) and also that there are very smart people in the court room. IMHO there must have been something else in this story for it to have gone to 5 years for Evans and nothing at all for McDonald, again thats an assumption but from what people know about the story in this thread there is no way he should have been found guilty whatsoever, no court room in the world would find him guilty from what has been said in this thread.
Josh, I didn't make the assumption that she was too drunk to consent - the whole case revolved around that fact. And it was widely reported as such. Now, you referenced assumption in the plural. What were the other assumptions? And it's not a bullshit reason - it's the law. End of. As for your second point, I did earlier reference the fact that people were making assumptions based on snippets of information. What you've read on this forum would take 20 mins to be discussed in a court. It's probably an assumption on my part, but I suspect the case ran a little longer than 20 mins, generating exponentially more evidence than we've discussed here.
I would like to congratulate you Leeds fans! I have seen several threads on this trial and sentencing, most of them are just aimed directly at Ched Evans and labeling him as being a scum-bag low life with little or no discussion about the law or evidence as presented in newspapers or online. So good to see a discussion on the subject and, with probably everyone else that did not sit on the jury, I do not know ALL the details of the case have a little sympathy for Evans for a variety of reasons. I cannot say he was or was not guilty, same goes for McDonald - I just do not know but from what I have read there does appear to be a hint (maybe more than just a hint) of double standards on a few levels. I have a problem getting my head round the fact McDonald was acquitted and Ched was not, for effectively doing the same thing .i.e having sex with a drunk girl who allegedly gave verbal consent.
Morning all I couldn't believe it when a Millwall mate texted me about him being banged up the other day , I honestly didn't know about the case but he certainly didn't let it effect his game scoring goals for fun this season, we were linked with him last summer after Sheff U's relegation presumably to cut costs and some wall geezers were saying its a done deal but now I'm glad we left well alone That's the only thing that has stuck in my mind about Ched Evans this season scoring goals for fun as it was the same Millwall mate who said about him scoring so many goals this season so why didn't we get him so perhaps that's why Kenny left well alone.

But that was what I was saying, there are obviously details that we are missing here so to make any decision to whether he is guilty or not means that you are assuming certain circumstances. The assumptions plural was more from the other side of the argument than yours but you have had to still make them. Its not a criticism otherwise there'd be no point to a forum but I am just pointing out that to get to your final decision, all or rather some of your opinions are coming from things that are not known to fact.
