Not the contractor's fault that the driver went Radio Rental because he thought he'd been diddled £600. There is such as thing as vicarious liability where the contractor could end up being held to blame but as this appears to be criminal damage and not civil damage I'd say they had a good defence against prosecution. It would have to be proven that they had been negligent in some way but I don't see how you can anticipate one of your operatives is going to take a digger and smash up the front of a hotel.
Hard to feel sympathy for anyone in this case. The driver of the digger is clearly a dick for not checking his bank account and, well, it's a Travelodge.
In fairness their rooms aren't much of an improvement on prison cells, not a patch on Premier Inn, just ask Lenny Henry.
